The above-captioned matter was heard as a contested case on August 6, 2010, and October 26, 2010, at which times the complainant and the respondent appeared and presented testimony, exhibits and argument on the complaint.  

 

            On December 15, 2010, the complainant filed a withdrawal of the complaint in this matter.  The Commission takes administrative notice of such withdrawal.

 

The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint.

 

            1.  The complaint is dismissed.
