The above-captioned matter was scheduled to be heard as a contested case on January 25, 2010, at which time the complainants and the respondents appeared. At the hearing on this matter, the parties indicated that eleven of the twelve records requested by the complainants had either been provided, or do not exist, and that they had reached an agreement that would resolve the one outstanding records request, which agreement was stated on the record as follows:
The respondents will provide “all records relating to internal investigations, or communications about such investigations (including any records of complaints filed with the East Haven Police Department), of the East Haven Police Department’s use of excessive, deadly or lethal force, conducted between April 14, 1991 and March 25, 2009,” to the extent any such records exist and are maintained by the respondents. The respondents will provide said records on, or before, February 12, 2010, and at no cost to the complainants.
While the Commission has some concerns about the respondents’ delay in fully complying with the complainants’ records requests, which requests were made by letter dated March 27, 2009, the parties are commended for reaching an amicable settlement of the matters in this case.
