The above-captioned matter was heard as a contested case on August 19, 2008, at which time the complainants and the respondents appeared, stipulated to certain facts and presented testimony, exhibits and argument on the complaint.

 

1.  The respondents are public agencies within the meaning of 1-200(1), G.S.

 

2.  By letter of complaint dated and filed May 2, 2008, the complainants appealed to the Commission, alleging that the respondents violated the Freedom of Information (“FOI”) Act by denying their request to gain access to or copies of a state police incident report.

 

3.  It is found that, by letter dated March 18, 2008, the complainants requested that the respondents provide them with “access to or copies of the police report on an incident on March 15, 2008 in Derby on Route 8.”  Such request pertained to the arrest of Toai Nguyen, who was allegedly “charged with first-degree assault on an elderly person and criminal attempt to commit murder” (Hereinafter “the report”).

 

4.  It is found that the respondents replied by letter dated March 20, 2008 indicating to the complainants that the respondents would commence a search for the report upon receipt of a check for eight dollars.  Subsequent to such letter, the complainants sent a check to the respondents for eight dollars.

 

5.  It is found that the respondents sent a second letter to the complainants dated April 29, 2008 denying them access to the report by indicating that there was a “pending criminal prosecution” in the matter and that the disclosure of the report “would be prejudicial to their prospective law enforcement action.”

 

6.  At the hearing on this matter, the complainants claimed that they were charged a fee for the report, but were not provided a copy of the report by the respondents.

 

7.  The respondents contend that a search was conducted for the report pursuant to 29-10b, G.S., which permits the respondents to charge an eight dollar fee for a search and/or copy of each investigative report.  The respondents also contend that they eventually found the report, but decided to issue a press release in lieu of the report pursuant to 1-215, G.S.  The respondents provided the complainants with such press release in response to the complainants’ request for the report described in paragraph 3, above.

 

8.  The respondents further maintained that the entire report is exempt from disclosure pursuant to 1-215, G.S., and that portions of the report are exempt pursuant to 1-210(b)(2), 1-210(b)(3)(B) and (C), G.S.

 

9.  Section 1-200(5), G.S., provides:

 

“Public records or files” means any recorded data or information relating to the conduct of the public's business prepared, owned, used, received or retained by a public agency, or to which a public agency is entitled to receive a copy by law or contract under section 1-218, whether such data or information be handwritten, typed, tape-recorded, printed, photostated, photographed or recorded by any other method.

 

10.  Section 1-210(a), G.S., states in relevant part:

 

Except as otherwise provided by any federal law or state statute, all records maintained or kept on file by any public agency, whether or not such records are required by any law or by any rule or regulation, shall be public records and every person shall have the right to…receive a copy of such records in accordance with section 1-212.

 

11.  Section 1-212(a), G.S., states in relevant part:

 

Any person applying in writing shall receive, promptly upon request, a plain or certified copy of any public record.

 

12.  It is found that the respondents maintain the requested report and that, therefore, such report is a public record within the meaning of 1-200(5), 1-210(a), and 1-212(a), G.S.

 

 

13.  After the hearing on this matter, the Commission ordered the respondents to submit the report for in camera inspection.  Such report consists of 94 pages, which have been marked for identification purposes as IC# 2008-312-1 through IC# 2008-312-94.

 

14.  On the in camera index submitted with the report for in camera inspection, the respondents maintained their claim that the report was exempt from disclosure pursuant to 1-215, G.S.  The respondents also maintained that portions of the report were specifically exempt from disclosure pursuant to 1-210(b)(2) and 1-210(b)(3)(B), G.S.  The respondents further claimed that portions of the report were exempt from disclosure pursuant to 1-217, G.S., as the residential address of a sworn law enforcement officer.  

 

15.  Section 1-217, G.S., provides:   

 

“(a)  No public agency may disclose, under the Freedom of Information Act, the residential address of any of the following persons:…

 

(2)  A sworn member of a municipal police department or a sworn member of the Division of State Police within the Department of Public Safety….

 

16.  It is concluded that in camera record IC# 2008-312-2, line 18, contains the residential address of a sworn member of a municipal police department and therefore, 1-217(a)(2), G.S., exempts such record from disclosure.  It is further concluded that the respondents did not violate the FOI Act by denying the complainants copies of such portions of records.

 

17.  With regard to the disclosure of the “record of the arrest,” 1-215, G.S., states:

 

(a) Notwithstanding any provision of the general statutes to the contrary, and except as otherwise provided in this section, any record of the arrest of any person, other than a juvenile, except a record erased pursuant to chapter 961a, shall be a public record from the time of such arrest and shall be disclosed in accordance with the provisions of section 1-212 and subsection (a) of section 1-210, except that disclosure of data or information other than that set forth in subdivision (1) of subsection (b) of this section shall be subject to the provisions of subdivision (3) of subsection (b) of section 1-210.  Any personal possessions or effects found on a person at the time of such person's arrest shall not be disclosed unless such possessions or effects are relevant to the crime for which such person was arrested.

 

(b) For the purposes of this section, “record of the arrest” means (1) the name and address of the person arrested, the date, time and place of the arrest and the offense for which the person was arrested, and (2) at least one of the following, designated by the law enforcement agency:  The arrest report, incident report, news release or other similar report of the arrest of a person.

 

18.  It is concluded that 1-215, G.S., does not exempt records from public disclosure under the FOI Act, but rather mandates that, at a minimum, certain arrest records must be disclosed.  In instances where a public agency seeks to withhold other records not mandated to be disclosed pursuant to 1-215, G.S., such public agency must prove that an exemption applies to such other records.

 

19.  It is found that the respondents did make available to the complainants a press release concerning the arrest of Toai Nguyen, which included the name and address of Toai Nguyen, the date, time and place of his arrest and the offense for which he was arrested. 

 

20.  It is concluded that the respondents provided the “record of the arrest” within the meaning of 1-215, G.S.

 

21.  The respondents also maintain that 1-210(b)(3), G.S., operates to exempt the actual report that the complainants requested.

 

22.  Section 1-210(b)(3), G.S., provides, in relevant part, that nothing in the FOI Act shall be construed to require disclosure of:

 

“[r]ecords of law enforcement agencies not otherwise available to the public which records were compiled in connection with the detection or investigation of crime, if the disclosure of said records would not be in the public interest because it would result in the disclosure of … (B) signed statements of witnesses, (C) information to be used in a prospective law enforcement action if prejudicial to such action …”

 

23.  It is found that the Department of Public Safety, Division of State Police, is a law enforcement agency within the meaning of 1-210(b)(3), G.S., and that the respondents compiled the report in connection with the investigation into the arrest of Toai Nguyen.  It is also found that the report is not otherwise available to the public.

 

24.  It is found that in camera records IC# 2008-312-1 through IC# 2008-312-94 are comprised of signed statements of witnesses, narrative reports, examination reports, photography reports, and medical logs, among other reports and documents related to the incident described in paragraph 3, above.

 

25.  It is concluded that the signed statements of witnesses comprising in camera records IC# 2008-312-8 through 10 and IC# 2008-312-74 through 80 are permissibly exempt from disclosure pursuant to 1-210(b)(3)(B), G.S.  It is further concluded that the respondents did not violate the FOI Act by withholding such records from the complainants.

 

26.  In Department of Public Safety v. FOIC, 51 Conn. App. 100, 105 (1998), the court stated that 1-210(b)(3)(C), G.S., required an evidentiary showing that (1) the records are to be used in a prospective law enforcement action and (2) the disclosure of such records would be prejudicial to such action.  The court further stated that “the statute is not satisfied by the mere good faith assertion that the matter to which the information pertains is potentially criminal ... there must be an evidentiary showing that the actual information sought is going to be used in a law enforcement action and that the disclosure of that information would be prejudicial to that action.”

 

27.  It is found that a criminal case concerning the report was still pending in the judicial district of Ansonia/Milford at the time of the hearing in this matter.  The State’s Attorney assigned to the related criminal case testified that a pretrial was scheduled for August 20, 2008 on the criminal matter.  The State’s Attorney also testified that disclosure of the report would be prejudicial to the prosecution of Toai Nguyen since the report contains medical information, which the State’s Attorney believes is “intimately” related to the criminal defense of Toai Nguyen.  The State’s Attorney provided testimony that portions of the report pertain to injuries sustained by the victim in the criminal matter and that such portions are closely related to the State’s Attorney ability to meet its burden of proof in establishing the elements in the prosecution of Toai Nguyen.  The State’s Attorney also testified that disclosure of the report to media organizations such as the complainants could taint the jury pool selection for the criminal case.

 

28.  With respect to the argument that release of Mr. Nguyen’s medical information would assist in the defense of Toai Nguyen, and thus prejudice his prosecution, the Commission notes that it is well settled that the state must, as a matter of law, divulge exculpatory evidence to the defendant in a criminal matter.  It is therefore concluded that the respondents failed to prove that disclosure to the complainants of records required, under discovery, to be disclosed to the defense, does prejudice the law enforcement action. 

 

29.  With respect to the argument that portions of the report pertaining to the victim’s injuries are closely related to the prosecution’s ability to meet its burden of proof, the Commission is not persuaded that disclosure of the information impairs the prosecution’s ability to meet its burden.  Also, the Commission again observes that, to the extent the information is exculpatory, it may not be withheld from the defense.

 

30.  With respect to the issue of potential tainting of a jury pool, the Commission notes that it is the responsibility of the court to ensure the integrity of a jury.  Moreover, such a generalized contention could be made in virtually every criminal case, and a conclusion in favor of the respondents based on such generalization would be contrary to the holding in Department of Public Safety, supra.

 

31.  The Commission takes administrative notice of the fact that, in the ordinary course of a criminal trial, the respondents can expect that the state and the defendant will have conducted individual voir dire of jurors, that the court will have instructed jurors not to read newspapers or any other extra-evidential materials, or to discuss the case with other jurors, and that the court will check on the jurors at the commencement of the presentation of evidence to determine whether they have read or been influenced by any extra-evidential materials.

 

            32.  It is concluded that the court has existing safeguards against the juror misconduct such as reading newspaper reports of, or discussing, extra-evidential records, and that the Commission should not attempt to inject itself into those protective procedures by withholding the requested records from the general public.  Just as the rights of the public to inspect or copy public records are not limited by court discovery rules and orders, the rights of the public should not be limited by anticipated court-ordered restrictions on jurors’ access to records.  See Chief of Police v. FOIC, 252 Conn. 377 (2000).

 

33.  It is concluded that the respondents’ concerns about the tainting of the jury with extra-evidential investigatory records fails to satisfy the respondents’ burden of proof under 1-210(b)(3)(C), G.S. 

 

34.  It is concluded that the respondents failed to prove that disclosure of the in camera records not described in paragraphs 16 and 25, above, would prejudice a prospective law enforcement action if released.  Accordingly, it is concluded that such records are not exempt by virtue of 1-210(b)(3)(C), G.S.  It is further concluded that the respondents violated the FOI Act by withholding such records from the complainants.

 

35.  With respect to the respondents’ 1-210(b)(2), G.S., claim of exemption, such provision permits the nondisclosure of “personnel or medical files and similar files the disclosure of which would constitute an invasion of personal privacy.”

 

36.  The Supreme Court set forth the test for the 1-210(b)(2), G.S., exemption in Perkins v. Freedom of Information Commission, 228 Conn. 158, 175 (1993), which test has been the standard for disclosure of records pursuant to that exemption since 1993.  The Commission takes administrative notice of the multitude of court rulings, Commission final decisions (see Endnotes 1), and instances of advice given by Commission staff members (see Endnotes 2), which have relied upon the Perkins test, since its release in 1993.

 

37.  Specifically, under the Perkins test, the claimant must first establish that the files in question are personnel, medical or similar files.  Second, the claimant must show that disclosure of the records would constitute an invasion of personal privacy.  In determining whether disclosure would constitute an invasion of personal privacy, the claimant must establish both of two elements: first, that the information sought does not pertain to legitimate matters of public concern, and second, that disclosure of such information is highly offensive to a reasonable person.

 

38.  It is found that IC# 2008-312-13 constitutes “medical” or “similar files” within the meaning of 1-210(b)(2), G.S.  It is also concluded that such in camera record is exempt from disclosure pursuant to 1-210(b)(2), G.S., because there is no legitimate public interest in disclosure, and disclosure would be highly offensive to a reasonable person.  It is therefore concluded that the respondents did not violate the FOI Act by withholding such in camera record from the complainants.

           

39.  It is found that IC# 2008-312-19, line 25, IC# 2008-312-21, line 28, and IC# 2008-312-23, line 22 contain personal medical information concerning Mr. Nguyen.  It is found that such portions of the in camera records do not pertain to legitimate matters of public concern, and that disclosure of such information would be highly offensive to a reasonable person.  It is therefore concluded that such portions of the in camera records are permissibly exempt from disclosure pursuant to the provisions of 1-210(b)(2), G.S.

 

40.  It is therefore concluded that the respondents did not violate the FOI Act by withholding the in camera records described in paragraph 39, above.

 

41.  It is found that in camera records IC# 2008-312-6, line 14, IC# 2008-312-11, line 8, IC# 2008-312-18, line 12, IC# 2008-312-22, lines 24 and 38, IC# 2008-312-24, line 21, IC# 2008-312-33, line 38, and IC# 2008-312-45, line 38, do not constitute “personnel or medical files and similar files” within the meaning of 1-210(b)(2), G.S.  Moreover, it is found that such in camera records contain information that pertains to legitimate matters of public concern, and disclosure would not be highly offensive to a reasonable person.  Consequently, it is concluded that disclosure of such in camera records would not constitute an invasion of privacy and therefore, such in camera records are not exempt pursuant to 1-210(b)(2), G.S.  It is therefore concluded that the respondents violated the FOI Act by withholding such in camera records from the complainants. 

 

42.  With respect to the search fee, 1-212(a)(1), G.S., provides in relevant part that the fee for any copy provided in accordance with the FOI Act by a state agency “. . . shall not exceed twenty-five cents per page . . .”

 

43.  Section 29-10b, G.S., provides:

 

The Commissioner of Public Safety shall charge the following fees for the item or service indicated:

 

(1)    Each search of the record files made pursuant to a request for a

copy of an accident or investigative report which results in no

      document being produced, six dollars, and on and after July 1,

      1993, eight dollars.

 

(2)    Each copy of an accident or investigative report, six dollars,

and on and after July 1, 1993, eight dollars.

 

44.  It is found that the report is responsive to the complainants’ request and is an “investigative report” within the meaning of 29-10b, G.S. 

 

45.  It is concluded that the specific fee provisions set forth in 29-10b, G.S., supersede the more general fee provisions set forth in 1-212(a), G.S.  Consequently, the respondents did not violate the fee provisions of the FOI Act by charging the complainants eight dollars for the search of the report.

 

 

The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

 

1.  Forthwith the respondents shall provide to the complainants copies of the in camera records other than the portions described in paragraphs 16, 25, 38 and 39 of the findings, above. 

 

2.  Consistent with Commission precedent, the respondents may redact social security numbers from the records ordered released.

AFFIDAVIT OF ERIC V. TURNER

 

Eric V. Turner, having been duly sworn, does hereby depose as follows:

 

1.  I am over the age of eighteen (18) years and understand the obligation of an affirmation.

 

2.  I am a member of the Connecticut Bar and am currently employed as Director of Public Education for the Connecticut Freedom of Information Commission, having first been employed by said commission in 1996.

 

3.  I am providing this affidavit in light of the Supreme Court decision in Director, Retirement & Benefits Services Division v. Freedom of Information Commission, 256 Conn. 764 (2001), in which the court apparently invites a reconsideration of Perkins v. Freedom of Information Commission, 228 Conn. 158 (1993).  See, Director, supra at 782, fn 13, 785 (Zarella, J. concurring).

 

4.  As part of my responsibilities as Director of Public Education for said commission, I have developed, organized and scheduled speaking engagements, seminars and programs explaining the duties and rights established under the Connecticut Freedom of Information Act.

 

5.  Since I assumed my current position in 1996, there have been approximately 290 such speaking engagements, seminars and programs in Connecticut and I have personally lectured in approximately 80 such speaking engagements, seminars and programs.

 

6.  As part of the presentation I have prepared for such speaking engagements, seminars and programs, the subject of the Connecticut General Statues Section 1-210(b)(2) exemption for personnel, medical and similar files the disclosure of which would constitute an invasion of personal privacy is stressed because of the great interest in that exemption and the confusion generated by a series of inconsistent and contradictory court decisions prior to Perkins, supra.  See, e.g., Chairman v. Freedom of Information Commission, 217 Conn. 193 (1991) (establishing “reasonable expectation of privacy” test; query whether subjectively or objectively applied) and Board of Education v. Freedom of Information Commission, 210 Conn. 590 (1989) (confirming a “balancing” test), which was overruled by the Chairman case.

 

7.  Since the Supreme Court ruling in Perkins, supra, all Freedom of Information Commission staff members who conduct such speaking engagements, seminars and programs discuss in detail the rulings in that case and its progeny.

 

8.  As part of my responsibilities as Director of Public Education, I also answer telephone and other inquiries from public officials and the public.  Since my employment with said commission, I have answered thousands of such inquiries, including hundreds of inquiries concerning the Connecticut General Statutes Section 1-210(b)(2) exemption.  In responding to such inquiries I discuss in detail the Perkins case and its progeny.

 

9.  Based on the foregoing experiences, it is my opinion that the Perkins decision, and its progeny, have had a beneficial effect on public officials and the public itself because they can rely on a now long-standing and clear test with respect to the Connecticut General Statutes Section 1-210(b)(2) exemption, which helps them determine whether that exemption is applicable to the practical problems they encounter with respect to personnel, medical and similar information.  Indeed, the many court and Freedom of Information Commission decisions applying the Perkins test have given public officials and the public a now consistent body of law concerning that statutory exemption.
