The above-captioned matter was scheduled to be heard as a contested case on October 2, 2007, at which time the complainant and the respondents appeared and reported to the Commission that they had reached a settlement in this matter. 

           

Specifically, the parties agreed as follows:

 

1.      The respondent Board agrees that henceforth, when listing an item on its published agenda, it will comply with Sections 1-200(6) and 1-225(f) of the Connecticut General Statutes and specifically state the reason for convening in executive session.

 

2.      The respondent Board agrees that it will comply with the Order of the Freedom of Information Commission entered on August 8, 2007 in the matter of Smith v. Windsor Board of Education, Docket No. FIC 2007-003.

 

3.      The respondent Board agrees that it will comply with []1-225(a) of the Connecticut General Statutes and ensure that votes of members of the respondent Board  are reduced to writing and are available to the public within 48 hours, and that draft minutes of Board of Education meetings will be available for public inspection within seven days of the meeting.

4.      In consideration of the foregoing, the complainant hereby withdraws his complaint in Freedom of Information Commission Docket No. FIC 2007-213.

 

 

            The following order by the Commission is hereby recommended on the basis of the above-referenced settlement:

 

  1. Based on the withdrawal of the complaint, the case is hereby dismissed.
