The above-captioned matter was heard as a contested case on November 27, 2006, at which time the complainant and the respondent appeared, and stated on the record that they had reached a settlement in this matter.
Based upon the respondent’s acknowledgment at the hearing that, in the past, it has not acted in full compliance with the Freedom of Information Act (“FOIA”), and based further upon the respondent’s pledge to attend, on December 20, 2006, the Connecticut Conference of Municipalities seminar on FOIA compliance, the complainant agreed to withdraw the complaint in this matter.
The following orders by the Commission are hereby recommended on the basis of the record concerning the above-captioned complaint:
1. Based on the withdrawal of the complaint, the case is hereby dismissed.
2. The Commission commends the parties on having reached a non-litigated settlement in this matter.
