The above-captioned matter was heard as a contested case on January 22, 2004, at which time the complainant and the respondent appeared, stipulated to certain facts and presented testimony, exhibits and argument on the complaint.  In the course of the hearing, the parties agreed to the following in settlement of the complaint:

 

            1.  The respondent acknowledges its obligation to respond promptly to requests to inspect or copy records, in order to avoid being deemed to have denied the request pursuant to §1-206(a), G.S.

 

            2.  The respondent, in hindsight, acknowledges that it would have been the better course under the circumstances of this case to acknowledge the complainant’s request within four business days of receipt of the request.

 

3.  The complainant withdraws his complaint.

 

The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

 

1.      The complaint is dismissed.   The Commission thanks both parties for their cooperation in reaching this settlement.
