The above-captioned matter was scheduled to be heard as a contested case on September 25, 2001, at which time the complainant and the respondent appeared and informed the Commission that they had reached a settlement in this matter.  Specifically, the respondent agreed to provide the complainant with records that he requested on August 15, 2001, by close of business on September 25, 2001.  In consideration of such assurance, the complainant informed the Commission that he wished to withdraw his complaint.

 

The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint.

 

1.      The complaint is hereby dismissed.

 

2.   The Commission commends the parties for reaching a non-litigated settlement of this matter.
