            The above-captioned matter was heard as a contested case on October 5, 1992, at which time the complainants and the respondent appeared.  It is determined that because the notice of appeal in this matter was filed on September 30, 1991, the FOI Commission is deprived of subject matter jurisdiction pursuant to 1-21i(b), G.S.

 

            The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint.

 

            1.  The complaint is hereby dismissed.
