A regular meeting of the Freedom of Information Commission was held on January 27, 2010, in the Freedom of Information Hearing Room, 18-20 Trinity Street, Hartford, Connecticut. The meeting convened at 2:07 p.m. with the following Commissioners present:

 

             Commissioner Andrew J. O’Keefe, presiding

             Commissioner Sherman D. London

             Commissioner Dennis O’Connor (participated via speakerphone)

             Commissioner Norma E. Riess

             Commissioner Owen P. Eagan

                                                

           

Also present were staff members, Colleen M. Murphy, Eric V. Turner, Mary E. Schwind, Clifton A. Leonhardt, Victor R. Perpetua, Tracie C. Brown, Kathleen K. Ross, Lisa F. Siegel, Valicia D. Harmon, Paula S. Pearlman, Cindy Cannata and Thomas A. Hennick.

                    

            Those in attendance were informed that the Commission does not ordinarily record the remarks made at its meetings, but will do so on request.

 

            The Commissioners unanimously voted to adopt the minutes of the Commission’s regular meeting of January 13, 2010 and the minutes of the Commission’s special meeting of January 6, 2010.

              The Commissioners unanimously voted to adopt the Hearing Officer’s Report.

 

 

Docket #FIC 2009-607           Kevin Cunningham v. First Selectman, Town of Plainfield; and Town of Plainfield

 

               Paul Sweet appeared on behalf of the respondents. The Commissioners unanimously voted to amend the Hearing Officer’s Report. The Commissioners unanimously voted to adopt the Hearing Officer’s Report as amended.* The proceedings were recorded digitally.

 

                Lisa F. Seigel reported on the  New Britain Superior Court Memorandum of Decision in Commissioner, Dept. of Correction v. Freedom of Freedom of Information Commission, and Rashad El Badrawi; and United States of America, Comm. CT Department of Correction v. Freedom of Information Commission and Rashad El Badrawi, dated January 11, 2010.  The Commissioners voted unanimously to authorize the withdrawal of all commission appeals in the matter.

              

                Victor R. Perpetua reported on pending appeals.

AMENDMENT AND CORRECTION

 

Docket #FIC 2009-090           John Sylvia III v. Director of Human Resources, State of Connecticut, Department of Correction; and State of Connecticut, Department of Correction

 

            Paragraph 2 of the Hearing Officer’s Report is corrected as follows:

 

2.  It is found that by letter dated January 15, 2009, the complainant made a request to the respondent for a copy of Correctional Officer James Gilbert’s entire [personal] PERSONNEL file spanning his career as a correctional officer.

 

 

Docket #FIC 2009-607           Kevin Cunningham v. First Selectman, Town of Plainfield; and Town of Plainfield

 

              Paragraph 9 in the Hearing Officer’s Report is amended as follows:

 

      9.  It is found that the RESPONDENTS DID NOT DENY THE COMPLAINANT [complainant failed to prove that the respondents denied him] copies of any public records.
