RE: Minutes of the Commission’s regular meeting of December 10, 2008
A regular meeting of the Freedom of Information Commission was held on December 10, 2008, in the Freedom of Information Hearing Room, 18-20 Trinity Street, Hartford, Connecticut. The meeting convened at 2:14 p.m. with the following Commissioners present:
Commissioner Andrew J. O’Keefe, presiding
Commissioner Sherman D. London
Commissioner Dennis O’Connor
Commissioner Norma E. Riess
Also present were staff members, Mary E. Schwind, Victor R. Perpetua, Clifton A. Leonhardt, Kathleen K. Ross, Hank Pawlowski, Paula Pearlman, Valicia Harmon and Cindy Cannata .
Those in attendance were informed that the Commission does not ordinarily
record the remarks made at its meetings, but will do so on request.
The Commissioners unanimously voted to adopt the minutes of the Commission’s special meeting of December 2, 2008.
Docket #FIC 2007-713 Raymond J. Cerilli v. Chief, Police Department, City of New Haven; and Police Department, City of New Haven
Raymond Cerilli participated via speakerphone. Attorney Kathleen Foster appeared on behalf
of the respondents. The Commissioners unanimously voted to amend the Hearing Officer’s Report.
The Commissioners then unanimously voted to adopt the Hearing Officer’s Report as amended.* The
proceedings were recorded digitally.

David Taylor participated via speakerphone. Attorney Sandra Sharr appeared on behalf of the
respondents. The Commissioners unanimously voted to amend the Hearing Officer’s Report. The
Commissioners then unanimously voted to adopt the Hearing Officer’s Report as amended.* The

Hank Pawlowski reported on the 2009 legislative proposals. Formal action on the proposals was postponed.
Victor Perpetua and Valicia Harmon reported on appeals.

It is therefore found that the respondent’s failed to prove that [there are] THE COMMISSIONER OF CORRECTION HAD grounds to believe that disclosure of a correction officer’s disciplinary record to an inmate may result in a risk of harm, including a risk of disorder in a correctional institution, and thus that the requested records are exempt under § 1-210(b)(18), G.S.
