FREEDOM OF INFORMATION COMMISSION
OF THE STATE OF CONNECTICUT

 

                                               

The above-captioned matter was heard as a contested case on August 2, 2011, at which time both the complainant and the respondents appeared and presented testimony and argument on the complaint.

 

Based upon their presentations at the hearing, the complainant and the respondents agreed with each other that:

 

1.  There was a technical violation of §1-225(c), G.S., when the respondent Board of Finance at its March 3, 2011 meeting considered the “Harwinton House” STEAP grant pursuant to the agenda item “Old Business”;

 

2.  There was no violation of the Freedom of Information Act at the March 15, 2011 annual Town Meeting; and

 

3.  All actions of said Town Meeting remain in full force and effect.

 

As a result of these stipulations, the complainant stated that he wished to withdraw his complaint. The Commission recommends the following orders on the basis of the record:

 

1. Based on the withdrawal of the complaint, the case is hereby dismissed.

 

2. The Commission commends the parties, who live together in a small town, on having reached a settlement of this matter without full adjudication. The Commission hopes this result will facilitate positive interaction between the parties as their town addresses future public issues.
