The above-captioned matter was scheduled to be heard as a contested case on August 4, 2011, at which time the complainant and the respondent appeared.  At such time, the parties informed the Commission that they had settled the instant matter.  Specifically, the respondent informed the hearing officer that it will provide the requested records to the complainant with the following two types of redactions:  1) first the respondent will redact the name of a particular employee who is mentioned in the requested records; and 2) the respondent will redact all medical and health related information.  The complainant indicated on the record that these redactions were acceptable to him.

The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

1.      Based on the parties’ settlement, the case is hereby dismissed.

2.  The Commission commends the parties on having reached a non-litigated settlement in this matter.
