The above-captioned matter was heard as a contested case on June 14, 2011, at which time the complainant and respondents appeared and presented testimony, exhibits and argument on the complaint. 

 

            After consideration of the entire record, the following facts are found and conclusions of law are reached:

 

1.      The respondents are public agencies within the meaning of §1-200(1), G.S.

 

2.      It is found that on November 20, 2010, the complainant requested copies of records of:  a) all names and charges and dispositions of criminal cases against Department of Correction (“DOC”) administrators, staff, and employees from January 2005 through the present; and b) all ethics complaints filed against DOC administrators, staff, and employees from January 2005 through the present.

 

3.      It is found that the respondents acknowledged the complainant’s request on November 23, 2010.

 

4.      By letter of complaint filed December 13, 2010, the complainant appealed to the Commission, alleging that the respondents violated the Freedom of Information (“FOI”) Act by failing to provide him with the copies of records he requested, described in paragraph 2, above.

 

5.      It is found that the respondents denied the complainant’s request on December 21, 2010, based on a claim that §1-210(b)(18), G.S., exempted the records from mandatory disclosure.

 

6.      Section 1-200(5), G.S., defines “public records” as follows:

 

Public records or files means any recorded data or information relating to the conduct of the public's business prepared, owned, used, received or retained by a public agency, …whether such data or information be handwritten, typed, tape-recorded, printed, photostated, photographed or recorded by any other method.

 

7.      Section 1-210(a), G.S., provides, in relevant part:

 

Except as otherwise provided by any federal law or state statute, all records maintained or kept on file by any public agency, whether or not such records are required by any law or by any rule or regulation, shall be public records and every person shall have the right to (1) inspect such records promptly during regular office or business hours, (2) copy such records in accordance with subsection (g) of section 1-212, or (3) receive a copy of such records in accordance with section 1-212.

 

8.      Section 1-212(a), G.S., provides in relevant part:  “Any person applying in writing shall receive, promptly upon request, a plain or certified copy of any public record.”

 

9.      With respect to the complainant’s request for copies of records of ethics complaints, it is found that the respondents do not maintain such records.

 

10.   With respect to the complainant’s request for the names, charges, and dispositions of criminal cases of the respondent DOC’s administrators, staff, and employees, it is found that the respondent department’s Human Resources Unit maintains a log of the names of all employees who have reported arrests or receipt of a summons from a law enforcement agency or court in a criminal matter. 

 

11.   It is concluded that the records described in paragraph 10, above, are public records within the meaning of §§1-200(5) 1-210(a), and 1-212(a), G.S.

 

12.    DOC claims that such records are exempt from disclosure pursuant to §1-210(b)(18), G.S., which provides:

 

Nothing in the Freedom of Information Act shall be construed to require disclosure of:

Records, the disclosure of which the Commissioner of Correction...has reasonable grounds to believe may result in a safety risk, including the risk of harm to any person or the risk of an escape from, or a disorder in, a correctional institution or facility under the supervision of the Department of Correction... Such records shall include, but are not limited to:

(A)  Security manuals, including emergency plans contained or referred to in such security manuals;

(B)  Engineering and architectural drawings of correctional institutions or facilities or Whiting Forensic Division facilities;

(C)  Operational specifications of security systems utilized by the Department of Correction at any correctional institution or facility or Whiting Forensic Division facilities, except that a general description of any such security system and the cost and quality of such system may be disclosed;

(D)  Training manuals prepared for correctional institutions and facilities or Whiting Forensic Division facilities that describe, in any manner, security procedures, emergency plans or security equipment;

(E)  Internal security audits of correctional institutions and facilities or Whiting Forensic Division facilities;

(F)  Minutes or recordings of staff meetings of the Department of Correction or Whiting Forensic Division facilities, or portions of such minutes or recordings, that contain or reveal information relating to security or other records otherwise exempt from disclosure under this subdivision;

(G)  Logs or other documents that contain information on the movement or assignment of inmates or staff at correctional institutions or facilities; and

(H)  Records that contain information on contacts between inmates, as defined in section 18-84, and law enforcement officers[.]

13.   It is found that the complainant was an inmate in the custody of the DOC for approximately 20 years, but he had been fully discharged before he made his request for records in this case.

 

 

14.   Section 18-101f, G.S., provides, in relevant part:

 

A personnel or medical file or similar file concerning a current or former employee of the Department of Correction shall not be subject to disclosure under the Freedom of Information Act, as defined in section 1-200, to any individual committed to the custody or supervision of the Commissioner of Correction …

 

15.    It is concluded that the legislature enacted §18-101f, G.S., in 2010 to counteract decisions by this Commission that §1-210(b)(18), G.S., did not categorically exempt disclosure of the disciplinary records of DOC employees and staff to current inmates.  David P. 16.  Section 1-2z, G.S., the “plain meaning rule,” provides:

 

The meaning of a statute shall, in the first instance, be ascertained from the text of the statute itself and its relationship to other statutes. If, after examining such text and considering such relationship, the meaning of such text is plain and unambiguous and does not yield absurd or unworkable results, extratextual evidence of the meaning of the statute shall not be considered.

 

17.   It is concluded that the plain language of §18-101f, G.S., does not prohibit disclosure of DOC personnel records to former inmates such as the complainant.

 

18.   Moreover, if any ambiguity exists concerning the relationship between §1-210(b)(18), G.S., and §18-101f, G.S., with respect to disclosure of DOC personnel records to former inmates, examination of the legislative history of §18-101f, G.S., supports the conclusion that §1-210(b)(18), G.S., does not permit a blanket exemption from disclosure of such records to former inmates.   

 

19.   The legislative history of §18-101f, G.S., reveals the legislature’s intent to protect the safety of DOC employees and staff, with a clear awareness that the new law would apply only to requests by current inmates:

REP. WILLIAMS:

[T]he bill seems to indicate and I think through your explanation I've understood that it would exempt from FOI law certain requests from current inmates regarding current personnel of Department of Corrections. I guess I'm curious, through you, if this would also prohibit recently released inmates from filing FOI requests about current Department of Corrections officers.

 

 

REP. JARMOC:

 

[T]o clarify, this applies to current and former employees of the Department of Corrections. So that's current and former employees but it does not apply to a former inmate. It applies to an inmate in the custody of the Department of Corrections.

 

 

REP. WILLIAMS:

 

I thank the gentlelady for her answer. I certainly support this legislation and like many of my colleagues here, I've had the opportunity to visit some of our correctional facilities here in Connecticut and have always said that I certainly would not want to do the job that many of our state employees do at these facilities. It is a very dangerous jobs [sic]. … And so this little bit of added protection that we can give to them certainly is required and necessary and I would urge adoption. (Emphasis added.)

20.   It is concluded that the legislature made a deliberate choice not to limit the rights of former inmates to receive public records under the FOI Act and that had the legislature intended to limit the rights of former inmates, it would have done so.   

 

21.   It is concluded, based on the plain language of §18-101f, G.S., and its legislative history, that the legislature has clearly articulated a policy that public safety does not require a blanket exemption from disclosure of DOC personnel records to a former inmate.  

 

22.   “The Freedom of Information Act expresses a strong public policy in favor of the open conduct of government and free public access to government records.” Wilson v. Freedom of Information Commission, 181 Conn. 324, 328‑29 (1980). “The general rule under the Freedom of Information Act is disclosure with exceptions to the rule being narrowly construed.” (Citations omitted.)  Ottochian v. Freedom of Information Commission, 221 Conn. 393, 397 (1992).

 

23.   The respondents claim that §1-210(b)(18), G.S.,  permits them to withhold the requested records from the complainant because, the respondents suggest, he is likely to reoffend at some future date and again enter DOC custody.  The respondents suggested that the complainant would enter a correctional facility with knowledge of the criminal dispositions of those correctional officers who have criminal convictions.  The respondents submitted evidence about the safety risks that may result were current inmates to have access to DOC employees’ personnel files, in general, but not as to employees’ criminal charges and dispositions, in particular.

 

24.   The respondents submitted anecdotal evidence that a former inmate once used an internet search engine to learn the residential address of a correctional officer and tried to contact her through Facebook. 

 

25.   It is found, however, that the complainant requests only the name, criminal charges, and disposition of cases of DOC employees charged with criminal misconduct.  Furthermore, it is found that withholding such records pursuant to §1-210(b)(18), G.S., will not prevent the situation described in paragraph 24, above. 

 

26.   It is found that the respondents denied the complainant’s request based on his status as a former inmate and based on their personal and institutional knowledge of the complainant.

 

27.   It is found that, although the complainant had some disciplinary history while in the custody of DOC, he also was rewarded with “perks” given to inmates who behave well.

 

28.   The complainant asserts that because he has been completely discharged from DOC’s custody, he now stands in the same shoes as any other member of the general public in making his request for records under the FOI Act.

 

29.   It is found that the complainant no longer resides in Connecticut.  It is found that the complainant has married and moved with his wife to Ohio.  It is found that the complainant has a job in Ohio.

 

30.   It is well-settled law that “whether records are disclosable under the act does not depend in any way on the status or motive of the applicant for disclosure, because the act vindicates the public's right to know, rather than the rights of any individual.”  (Citation omitted.)  Chief of Police v. Freedom of Information Commission, 252 Conn. 377, 387 (2000).

 

31.   It is found, moreover, that had the complainant sought to inspect records, rather than receive copies, he would not have been required to identify himself to the respondents.  Hodge v. Freedom of Information Commission, CV074015767S, Judicial District of New Britain at New Britain (November 10, 2008) (violation of FOI Act to require requester to provide name as condition to inspection of public records); Kevin Kennedy v. Colchester Emergency Communications, Inc.; Docket #FIC2004-264 (improper for public agency to require complainant to identify himself as condition to permitting access to inspect requested records); Advisory Opinion #79 (no statutory provision [requires] requester to give name … as condition precedent to inspecting or receiving copy of death or marriage certificate).

 

32.   It is concluded that the respondents failed to prove that §1-210(b)(18), G.S., exempts the records, described in paragraph 2.a, above, from mandatory disclosure.

 

33.   The respondents did not claim that §1-210(b)(2), G.S., exempts the records requested by the complainant.  It is found that the respondents, nevertheless, provided notice of the complainant’s request to employees whose names appear in the Human Resources’ log, described in paragraph 11, above.*  It is found that five current and former employees of DOC intervened in this matter for the purposes of providing testimony at the hearing.**

 

34.   The five intervenors claimed that disclosure may create a safety risk, and that disclosure would constitute an invasion of personal privacy.

 

35.   Section 1-210(b)(2), G.S., provides in relevant part that nothing in the FOI Act shall require the disclosure of  “personnel or medical files and similar files the disclosure of which would constitute an invasion of personal privacy. . . .”

 

36.   The Supreme Court set forth the test for the exemption contained in §1-210(b)(2), G.S., in Perkins v. Freedom of Information Commission, 228 Conn. 158, 175 (1993).   The claimant must first establish that the files in question are personnel, medical or similar files.  Second, the claimant must show that disclosure of the records would constitute an invasion of personal privacy.  In determining whether disclosure would constitute an invasion of personal privacy, the claimant must establish both of two elements: first, that the information sought does not pertain to legitimate matters of public concern, and second, that the disclosure of such information is highly offensive to a reasonable person.  The Commission takes administrative notice of the multitude of court rulings, commission final decisions,1 and instances of advice given by the Commission staff members,2 which have relied upon the Perkins test, since its release in 1993.

 

37.   It is found that the records requested by the complainant are part of the intervening employees’ personnel and similar files, within the meaning of §1-210(b)(2), G.S.

 

38.   It is concluded that personnel records, such as the records requested by the complainant, “are presumptively legitimate matters of public concern.”  Perkins, supra, at 168.  It is also concluded that the public has a valid interest in its employees’ conduct. 

 

39.   It is found, moreover, that the information that the complainant requested is not confidential and is available to the public through court records, except for records that are deemed to be erased by operation of law (see paragraph 43, below).

 

40.   It is found that, except for records that are deemed to be erased, information in the records requested by the complainant is a legitimate matter of public concern.

 

41.   It is also found that, except for records that are deemed to be erased, disclosure of such information would not be highly offensive to a reasonable person.

 

42.   It is found that, except for records that are deemed to be erased, disclosure of the records requested by the complainant would not constitute an invasion of personal privacy within the meaning of §1-210(b)(2), G.S.

 

43.   With respect to arrest and disposition information concerning employees whose records are deemed to be erased, §54-142a, G.S., provides in relevant part:

 

(a)    Whenever in any criminal case, on or after October 1, 1969, the accused, by a final judgment, is found not guilty of the charge or the charge is dismissed, all police and court records and records of any state's attorney pertaining to such charge shall be erased upon the expiration of the time to file a writ of error or take an appeal, if an appeal is not taken, or upon final determination of the appeal sustaining a finding of not guilty or a dismissal, if an appeal is taken.

                        …

 

(c) Whenever any charge in a criminal case has been nolled in the Superior Court, or in the Court of Common Pleas, if at least thirteen months have elapsed since such nolle, all police and court records and records of the state's or prosecuting attorney or the prosecuting grand juror pertaining to such charge shall be erased.

 

44.   Section 54-142c(a), G.S., provides in relevant part:

 

The clerk of the court or any person charged with retention and control of erased records . . . or any criminal justice agency having information contained in such erased records shall not disclose to anyone the existence of such erased records or information pertaining to any charge erased under any provision of this part, except as otherwise provided in this chapter. 

 

45.   It is concluded that information pertaining to the arrest of DOC employees that resulted in a dismissal or a nolle, if at least 13 months have elapsed since such nolle, is deemed to be erased and the respondents are prohibited from disclosing such information to the complainant.

 

46.   It is also found that the complainant has withdrawn his request for the charge and disposition information concerning the fifth intervening employee who testified at the hearing in this matter.

 

47.   With the exception of the records described in paragraphs 45 and 46, above, it is concluded that the respondents violated the FOI Act by failing to provide the complainant with the records he requested, described in paragraph 2.a, above.

 

The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

 

1.      With the exception of those records described in paragraphs 45 and 46 in the findings of fact, the respondents shall forthwith provide to the complainant, free of charge, all records reflecting the names and charges and dispositions of criminal cases against Department of Correction (“DOC”) administrators, staff, and employees from January 2005 through November 20, 2010.

AFFIDAVIT OF ERIC V. TURNER

 

Eric V. Turner, having been duly sworn, does hereby depose as follows:

 

1.  I am over the age of eighteen (18) years and understand the obligation of an affirmation.

 

2.  I am a member of the Connecticut Bar and am currently employed as Director of Public Education for the Connecticut Freedom of Information Commission, having first been employed by said commission in 1996.

 

3.  I am providing this affidavit in light of the Supreme Court decision in Director, Retirement & Benefits Services Division v. Freedom of Information Commission, 256 Conn. 764 (2001), in which the court apparently invites a reconsideration of Perkins v. Freedom of Information Commission, 228 Conn. 158 (1993).  See, Director, supra at 782, fn 13, 785 (Zarella, J. concurring).

 

4.  As part of my responsibilities as Director of Public Education for said commission, I have developed, organized and scheduled speaking engagements, seminars and programs explaining the duties and rights established under the Connecticut Freedom of Information Act.

 

5.  Since I assumed my current position in 1996, there have been approximately 290 such speaking engagements, seminars and programs in Connecticut and I have personally lectured in approximately 80 such speaking engagements, seminars and programs.

 

6.  As part of the presentation I have prepared for such speaking engagements, seminars and programs, the subject of the Connecticut General Statues Section 1-210(b)(2) exemption for personnel, medical and similar files the disclosure of which would constitute an invasion of personal privacy is stressed because of the great interest in that exemption and the confusion generated by a series of inconsistent and contradictory court decisions prior to Perkins, supra.  See, e.g., Chairman v. Freedom of Information Commission, 217 Conn. 193 (1991) (establishing “reasonable expectation of privacy” test; query whether subjectively or objectively applied) and Board of Education v. Freedom of Information Commission, 210 Conn. 590 (1989) (confirming a “balancing” test), which was overruled by the Chairman case.

 

7.  Since the Supreme Court ruling in Perkins, supra, all Freedom of Information Commission staff members who conduct such speaking engagements, seminars and programs discuss in detail the rulings in that case and its progeny.

 

8. As part of my responsibilities as Director of Public Education, I also answer telephone and other inquiries from public officials and the public.  Since my employment with said commission, I have answered thousands of such inquiries, including hundreds of inquiries concerning the Connecticut General Statutes Section 1-210(b)(2) exemption.  In responding to such inquiries I discuss in detail the Perkins case and its progeny.

 

9.  Based on the foregoing experiences, it is my opinion that the Perkins decision, and its progeny, have had a beneficial effect on public officials and the public itself because they can rely on a now long-standing and clear test with respect to the Connecticut General Statutes Section 1-210(b)(2) exemption, which helps them determine whether that exemption is applicable to the practical problems they encounter with respect to personnel, medical and similar information.  Indeed, the many court and Freedom of Information Commission decisions applying the Perkins test have given public officials and the public a now consistent body of law concerning that statutory exemption.

* It is concluded that such notice was improper.  Section 1-214, G.S., requires a public agency to notify an employee of a request to inspect or copy records contained in an employee’s personnel or medical and similar files only when the agency reasonably believes that the disclosure of such records would legally constitute an invasion of privacy within the meaning of §1-210(b)(2), G.S.

 

** It is concluded that intervention was permitted only pursuant to §1-21j-31(a), Reg. of State Agencies.  It is further concluded that §1-214(c), G.S., did not authorize DOC to withhold the records and §1-206(b)(1), G.S., did not authorize the employees’ intervention.
