The above-captioned matter was scheduled for hearing as a contested case on June 14, 2011, at which time both the complainant and the respondents appeared. Following a preliminary introduction of the case and review of the hearing procedures on the record, the parties agreed with each other to hold an off the record settlement conference without the presence of the hearing officer.  After the settlement conference, the complainant and the respondents informed the Commission that they had settled the complaint in this matter.  In consideration of such settlement, the complainant withdrew the complaint.

 

The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

 

1.      Based on the withdrawal of the complaint, the case is hereby dismissed.

 

2.  The Commission commends the parties on having reached a settlement in this matter without full adjudication.
