The above-captioned matter was scheduled to be heard as a contested case on April 28, 2011 at which time the complainant and the respondent appeared. Mr. Ian Cooke, the subject of the records requested in this matter, requested and was granted intervener status. Mr. Ian Cooke, who is incarcerated, appeared via teleconference.
The hearing in this matter was continued to give the parties an opportunity to resolve the matter without a hearing.
By letter dated and received on June 15, 2011, the complainant withdrew his complaint.
The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:
1. The complaint is hereby dismissed.
2. All parties are commended for their diligent efforts in resolving this matter.
