The above-captioned matter was heard as a contested case on March 10, 2011, at which time the complainants and respondents appeared and presented testimony, exhibits and argument on the complaint. Jennifer Gottlieb moved without objection to intervene as party respondent and was granted party status, having satisfied the requirements of §1-21j-30 of the Regulations of Connecticut State Agencies.

 

            After consideration of the entire record, the following facts are found and conclusions of law are reached:

 

1.      The respondents are public agencies within the meaning of §1-200(1), G.S.

 

2.      It is found that on September 16, 2010, the complainants made a written request for a copy of the recommendations portion of a certain report by the respondents’ Employee Assistance Program. 

 

3.      It is found that on September 21, 2010, the intervenor, through her attorney, informed the respondents that she objected to disclosure of the records requested by the complainants.

 

4.      It is found that on September 22, 2010, the respondents informed the complainants that §52-146q, G.S., prohibited them from disclosing the records requested by the complainants.

 

5.      By letter filed October 12, 2010, the complainants appealed to the Commission, alleging that the respondents violated the Freedom of Information (“FOI”) Act by failing to provide them with the records they requested. 

 

6.      Section 1-200(5), G.S., defines “public records” as follows:

 

Public records or files means any recorded data or information relating to the conduct of the public's business prepared, owned, used, received or retained by a public agency, …whether such data or information be handwritten, typed, tape-recorded, printed, photostated, photographed or recorded by any other method.

 

7.      Section 1-210(a), G.S., provides, in relevant part:

 

Except as otherwise provided by any federal law or state statute, all records maintained or kept on file by any public agency, whether or not such records are required by any law or by any rule or regulation, shall be public records and every person shall have the right to . . .  receive a copy of such records in accordance with section 1-212.

 

8.      Section 1-212(a), G.S., provides in relevant part:  “Any person applying in writing shall receive, promptly upon request, a plain or certified copy of any public record.”

 

9.      It is concluded that the records requested by the complainants are public records within the meaning of §§1-200(5), 1-210(a), and 1-212(a), G.S.

 

10.  It is found that when the intervenor served as assistant city manager, employees of the Community Development Department alleged that she created a hostile work environment.  It is found that the respondents asked the city’s Employee Assistance Program for assistance in resolving the employees’ concerns.

 

11.   It is found that the Employee Assistance Program is run by a private entity that contracts with the respondents to provide social work services to the respondents’ employees.

 

12.   It is found that a licensed social worker met individually with each of the employees, including the intervenor, involved in the alleged hostile work environment.  It is found that the social worker and the intervenor considered such one-on-one consultations to be confidential. 

 

13.   It is found that a social worker also met with employees in groups.

 

14.   It is found that following the meetings, the social worker completed a preliminary report, an action plan, recommendations, and a final report.  It is found that the complainants seek a copy of the preliminary recommendations and final recommendations. The respondents submitted a copy of the preliminary report, action plan, recommendations, and final report for in camera inspection, which records shall be identified herein as IC-2010-630-1 through IC-2010-630-5.

 

15.   It is found that the records described in paragraph 14, above, refer to individual employees only by the first initial of the employee’s first name.  It is found that the records requested by the complainants do not identify any of the employees.

 

16.   It is found that the social worker shared his recommendations and action plan with employees of the Community Development office, the respondents’ city manager, director of Human Resources, and the union steward, and delivered the reports to the city manager, the respondents’ counsel, and the respondents’ director of Human Resources.

 

17.   The intervenor objects to disclosure of the recommendations, and cites §52-146q(b), G.S., which prohibits a social worker from disclosing confidential communications.

 

18.   Section 52-146q(b), G.S., provides, in relevant part:

 

All communications and records shall be confidential and … a social worker shall not disclose any such communications and records unless the person or his authorized representative consents to such disclosure. Any consent given shall specify the individual or agency to which the communications and records are to be disclosed, the scope of the communications and records to be disclosed, the purpose of the disclosure and the expiration date of the consent. A copy of the consent form shall accompany any communications and records disclosed. The person or his authorized representative may withdraw any consent given under the provisions of this section at any time by written notice to the individual with whom or the office in which the original consent was filed. The withdrawal of consent shall not affect communications and records disclosed prior to notice of the withdrawal, except that such communications and records may not be redisclosed after the date of the notice of withdrawal. 

 

19.   Section 52-146q(a), G.S., provides the following definitions:

 

       (1) "Person" means an individual who consults a social worker for purposes of evaluation or treatment;

       (2) "Social worker" means an individual licensed as a clinical social worker pursuant to chapter 383b or an individual reasonably believed by the person to be so licensed;

       (3) "Communications and records" means all oral and written communications and records thereof relating to the evaluation or treatment of a person between such person and a social worker, or between a member of such person's family and a social worker, or between such person or a member of such person's family and an individual participating under the supervision of a social worker in the accomplishment of the objectives of evaluation or treatment, wherever made;

       (4) "Consent" means consent given in writing by the person or his authorized representative[.]

 

20.   It is concluded that §52-146q, G.S., like all other privileges created in Chapter 899, Title 52, “Evidence,” articulates the duty of only the party who directly receives confidential information from or about a patient or client or an agent of such party.  See, for example, §52-146k, G.S. (“a battered women’s counselor or a sexual assault counselor shall not disclose any confidential communications…”); §52-146o (“a physician or surgeon … shall not disclose … any communication made to him by, or any information obtained by him from, a patient…”); §52-146p (“a marital and family therapist shall not disclose any [privileged] communications…”); §52-146r (“a government attorney shall not disclose any [confidential] communications…”). 

 

21.   By contrast, it is concluded that other non-disclosure statutes apply not only to the party who directly receives certain communications, but to anyone with such information.  See, for example, §17-101k, G.S., which applies to any person who maintains or receives confidential information about child abuse:  “The information contained in the registry and any other information relative to child abuse, wherever located, shall be confidential…” Also see §19a-583, G.S.: “No person who obtains confidential HIV-related information may disclose or be compelled to disclose such information…”

 

22.    It is concluded that §52-146q, G.S., burdens only the social worker with a duty to maintain confidentiality. 

 

23.  It is found that the intervenor communicated with the social worker because her employer required her participation.  It is found that the intervenor did not consult the social worker for purposes of evaluation or treatment for mental health issues, within the meaning of §52-146q(a), G.S.  It is found, also, that the records requested by the complainants reflect recommendations as to resolution of the respondents’ employee relations difficulties, and do not reflect intimate details of the intervenor’s life as may be expected from a consultation for evaluation or treatment for mental health issues.

 

24.   It is found, therefore, that the records requested by the complainants are not “communications and records … relating to the evaluation or treatment of a person,” within the meaning of §52-146q, G.S.  

 

25.  It is concluded, accordingly, that such records are not confidential pursuant to §52-146q(b), G.S., and the statute does not provide a basis for the respondents to withhold the records from the complainants.

 

26.   The respondents claim that §1-210(b)(2), G.S., exempts the records from mandatory

 disclosure. 

 

27.   Section 1-210(b)(2), G.S., provides in relevant part that nothing in the FOI Act shall require the disclosure of  “personnel or medical files and similar files the disclosure of which would constitute an invasion of personal privacy. . . .”

 

28.   The Supreme Court set forth the test for the exemption contained in §1-210(b)(2), G.S., in Perkins v. Freedom of Information Commission, 228 Conn. 158, 175 (1993).   The claimant must first establish that the files in question are personnel, medical or similar files.  Second, the claimant must show that disclosure of the records would constitute an invasion of personal privacy.  In determining whether disclosure would constitute an invasion of personal privacy, the claimant must establish both of two elements: first, that the information sought does not pertain to legitimate matters of public concern, and second, that the disclosure of such information is highly offensive to a reasonable person.  The Commission takes administrative notice of the multitude of court rulings, commission final decisions,1 and instances of advice given by the Commission staff members,2 which have relied upon the Perkins test, since its release in 1993.

 

29.   Upon careful inspection of IC-2010-630-1 through IC-2010-630-5, it is found that disclosure of the records requested by the complainants – i.e., the preliminary and final recommendations – are personnel records, within the meaning of §1-210(b)(2), G.S.

 

30.   It is found that such records pertain to legitimate matters of public concern, such as the efficacy of the private consulting group who performed the intervention services for the respondents and the steps recommended to the respondents to avoid workplace problems in the future. 

 

31.  It is also found that disclosure of such records would not be highly offensive to a reasonable person.  As indicated in paragraph 15, above, the records neither identify any employee by name nor do they reveal intimate or non-work-related matters.

 

32.   It is concluded that disclosure of the records requested by the complainants would not constitute an invasion of personal privacy, within the meaning of §1-210(b)(2), G.S.

 

33.  Accordingly, it is concluded that the respondents violated the FOI Act by withholding the records from the complainants. 

 

The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

 

1.       Forthwith, the respondents shall provide a copy to the complainants of the requested preliminary and final recommendations, referenced in paragraph 14 of the findings, above.

Eric V. Turner, having been duly sworn, does hereby depose as follows:

 

1.  I am over the age of eighteen (18) years and understand the obligation of an affirmation.

 

2.  I am a member of the Connecticut Bar and am currently employed as Director of Public Education for the Connecticut Freedom of Information Commission, having first been employed by said commission in 1996.

 

3.  I am providing this affidavit in light of the Supreme Court decision in Director, Retirement & Benefits Services Division v. Freedom of Information Commission, 256 Conn. 764 (2001), in which the court apparently invites a reconsideration of Perkins v. Freedom of Information Commission, 228 Conn. 158 (1993).  See, Director, supra at 782, fn 13, 785 (Zarella, J. concurring).

 

4.  As part of my responsibilities as Director of Public Education for said commission, I have developed, organized and scheduled speaking engagements, seminars and programs explaining the duties and rights established under the Connecticut Freedom of Information Act.

 

5.  Since I assumed my current position in 1996, there have been approximately 290 such speaking engagements, seminars and programs in Connecticut and I have personally lectured in approximately 80 such speaking engagements, seminars and programs.

 

6.  As part of the presentation I have prepared for such speaking engagements, seminars and programs, the subject of the Connecticut General Statues Section 1-210(b)(2) exemption for personnel, medical and similar files the disclosure of which would constitute an invasion of personal privacy is stressed because of the great interest in that exemption and the confusion generated by a series of inconsistent and contradictory court decisions prior to Perkins, supra.  See, e.g., Chairman v. Freedom of Information Commission, 217 Conn. 193 (1991) (establishing “reasonable expectation of privacy” test; query whether subjectively or objectively applied) and Board of Education v. Freedom of Information Commission, 210 Conn. 590 (1989) (confirming a “balancing” test), which was overruled by the Chairman case.

 

7.  Since the Supreme Court ruling in Perkins, supra, all Freedom of Information Commission staff members who conduct such speaking engagements, seminars and programs discuss in detail the rulings in that case and its progeny.

 

8.  As part of my responsibilities as Director of Public Education, I also answer telephone and other inquiries from public officials and the public.  Since my employment with said commission, I have answered thousands of such inquiries, including hundreds of inquiries concerning the Connecticut General Statutes Section 1-210(b)(2) exemption.  In responding to such inquiries I discuss in detail the Perkins case and its progeny.

 

9.  Based on the foregoing experiences, it is my opinion that the Perkins decision, and its progeny, have had a beneficial effect on public officials and the public itself because they can rely on a now long-standing and clear test with respect to the Connecticut General Statutes Section 1-210(b)(2) exemption, which helps them determine whether that exemption is applicable to the practical problems they encounter with respect to personnel, medical and similar information.  Indeed, the many court and Freedom of Information Commission decisions applying the Perkins test have given public officials and the public a now consistent body of law concerning that statutory exemption.
