The above-captioned matter was heard as a contested case on March 24, 2011, at which time the complainant and the respondents appeared and presented testimony, exhibits and argument on the complaint.  The case caption has been amended to accurately identify the town council as a respondent.   

           

            On June 13, 2011, the complainant filed with the Commission a withdrawal of the complaint in this matter.  The Commission takes administrative notice of such withdrawal.

 

The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

            1.   Based upon the withdrawal of the complaint, the case is hereby dismissed.
