In the Matter of a Complaint by FINAL DECISION

The above-captioned matter was heard as a contested case on April 14, 2011, at which time both the complainant and the respondent appeared and presented testimony, exhibits and argument on the complaint. These presentations concerned a discussion about police officers in schools during an executive session at the respondent’s September 14, 2010 meeting. The use of a taser device on a student in a school cafeteria caused the discussion at issue.

 

Following their presentations at the hearing, the complainant and the respondent agreed with each other that:

 

1.  The executive session at the respondent’s September 14, 2010 meeting seemed to be for lawful purposes involving security strategy and personally identifiable information relating to specific students, except for some brief discussion concerning the possibility of future, related litigation;

 

2.  The lawful reasons for the executive session were not stated completely, in violation of §1-225(f), G.S.; and

 

3.  Henceforth, the respondent will state the reasons for any executive session as   required by the Freedom of Information Act.

 

As a result of these stipulations, the complainant stated that he wished to withdraw his complaint. The Commission recommends the following orders on the basis of the record:

 

1. Based on the withdrawal of the complaint, the case is hereby dismissed.

 

2. The Commission warmly commends the parties on having reached a      settlement of this matter without full adjudication.
