The above-captioned matter was scheduled to be heard as a contested case on February 8, 2011, at which time the complainant and the respondents appeared and presented evidence in this case.  After the presentation of evidence, counsel for the respondents moved that the hearing be continued.  Counsel explained that she had just been assigned to this case, and that the attorney with the most knowledge of the matters involved in this case would be able to cover this hearing with a very short continuance.  The parties also represented to the hearing officer that they were continuing to work to resolve the issues in this case.  Counsel’s motion for a brief continuance was granted and the contested case hearing in this matter was rescheduled for March 8, 2011.

 

By letter filed March 3, 2011, the complainant informed the Commission that the parties had resolved this case and he withdrew his complaint.  The Commission takes administrative notice of such letter.

The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

1.      Based on the withdrawal of the complaint, the case is hereby dismissed.

2.  The Commission commends the parties on having reached a settlement in this matter.
