The above-captioned matter was scheduled for hearing as a contested case on December 2, 2010, at which time both the complainant and the respondents appeared. The respondents immediately acknowledged that their response to the complainant’s request for records had not been prompt. Following an off the record conference for the respondents to confer privately with their counsel concerning remedies requested by the complainant, the respondents stated on the record their terms for settling the case. The complainant then stated that, based on these terms, he wished to withdraw his complaint in the above captioned matter.
The terms agreed to by the parties are that: 1) the respondents stipulate that their response to the complainant’s records request was not prompt; 2) the respondent Superintendent of Schools will address a letter of apology to the complainant forthwith, following the adoption of the final decision in this contested case; 3) the respondents will request that the Commission conduct a Freedom of Information Act workshop in Shelton, so that the workshop can be held prior to March 31, 2011; and 4) when the certified attendance report for 2009-2010 is completed, the respondents will promptly provide a copy to the complainant.
The Commission recommends the following orders on the basis of the record:
1. Based on the withdrawal of the complaint, the case is hereby dismissed.
2. The Commission warmly commends the parties on having reached a settlement in this matter without adjudication.
