The above-captioned matter was heard as a contested case on October 15, 2010, at which time both the complainant and the respondent appeared and presented testimony and argument on the complaint.

 

Following initial presentations at the hearing, the complainant and the respondent agreed to conduct an off the record settlement conference, without the presence of the hearing officer. Following their conference and after the resumption of the hearing, the parties informed the hearing officer of their agreement:

 

1. The respondent agreed to allow the public access to its meeting room fifteen minutes prior to the noticed time for the commencement of all meetings; and

 

2. Based upon the stipulation at paragraph 1, above, the complainant agreed to withdraw his complaint in the above captioned matter.

 

The Commission takes administrative notice of the complainant’s withdrawal and recommends the following order on the basis of the record:

 

1. Based on the withdrawal of the complaint, the case is hereby dismissed.

 

2. The Commission warmly commends the parties on having reached a settlement in this matter without full adjudication.
