The above-captioned matter was heard as a contested case on June 22, 2010, at which time the complainant and the respondents appeared, stipulated to certain facts, and presented evidence and argument on the complaint.  The motion of the New London Administrators’ Association to intervene was granted prior to the hearing.

 

During the hearing, the parties requested an opportunity to negotiate a settlement of the complaint, based on a narrowing of the complainant’s request.  That request was granted, and the respondents reviewed the requested files and offered the complainants copies of responsive records, which offer was accepted by the complainants in resolution of the complaint. 

 

The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

 

            1.  The complaint is dismissed.

 

2.      The parties are commended for reaching a settlement of the complaint.
