The above-captioned matter was scheduled for hearing as a contested case on August 18, 2010, at which time the complainant appeared, but due to a lack of actual notice, the respondents did not appear. A continued hearing was scheduled for September 16, 2010, at which time both the complainant and the respondents appeared. The respondents provided the complainant with the records he had requested, and then the complainant stated that he wished to withdraw his complaint and have it dismissed.

 

The Commission recommends the following orders on the basis of the record:

 

1.      The case is hereby dismissed.

 

2.  The Commission warmly commends the parties on having reached a settlement in this matter without adjudication.
