The above-captioned matter was heard as a contested case on July 16, 2010, at which time the complainant and the respondents appeared, stipulated to certain facts and presented testimony, exhibits and argument on the complaint. 

 

At the conclusion of the parties’ presentation of testimony and exhibits, the complainant indicated on the record that he wished to withdraw his complaint.

 

The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

 

1.  The complaint is hereby dismissed.

 

2.  The Commission commends the parties on having reached a settlement in this matter without full adjudication.
