FREEDOM OF INFORMATION COMMISSION
OF THE STATE OF CONNECTICUT

 

The above-captioned matter was scheduled to be heard as a contested case on December 7, 2010, at which time the complainant and the respondents appeared.  After hearing testimony on this case from the parties, the complainant and the respondents informed the Commission that they had reached an agreement settling the complaint.  Specifically, the respondents agreed to inquire as to whether the Police Chief for the Town of Windham (the “chief”) maintains any records that pertain to the complainant or the complainant’s home address that relate to or reflect any incidents, reports or complaints about the complainant made between January 1, 2010 and April 1, 2010.   The respondents further agreed, that subsequent to their inquiry with the chief, they will inform the complainant in writing whether the chief maintains any such records. Finally, the respondents agreed that, if the chief maintains any records, they will make such records available for the complainant’s review.  Based on the foregoing, the complainant withdrew his complaint. 

The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

1.      Based on the parties’ agreement, the case is hereby dismissed.

2.  The Commission commends the parties on having reached a settlement in this matter.
