            The above-captioned matter was heard as a contested case on September 20 and September 28, 2010, at which times the complainant and the respondents appeared and presented testimony, exhibits and argument on the complaint.

 

During the September 20, 2010 hearing, the respondent Family Support Council stated its willingness to review its records, in order to determine if it could identify records concerning which the complainant had previously requested copies. The respondent Family Support Council also stated that it would review procedures for the complainant to have access to buildings where it conducted business.

 

At the outset of the September 28, 2010 hearing, the respondent Family Support Council provided copies of records to the complainant which he had previously sought and hand-delivered a letter to the complainant outlining revised procedures for his access to buildings where the respondent Family Support Council conducts business. Also, at the September 28, 2010 hearing, the respondent State Advisory Council on Special Education agreed to the complainant’s suggestion that it conduct a Freedom of Information Act workshop at one of its meetings before December 31, 2010. Based upon these various actions by the respondents, the complainant informed the Commission that he wished to withdraw his complaint. 

 

 

 

The Commission recommends the following orders on the basis of the record:

 

1.      Based on the withdrawal of the complaint, the case is hereby dismissed.

 

2.  The Commission warmly commends the parties on having reached a settlement of this multifaceted matter, which has been trying for all the parties. The Commission also hopes this settlement of Freedom of Information Act issues will provide a foundation for an improved working relationship between the complainant and the respondents.
