FREEDOM OF INFORMATION COMMISSION

The above-captioned matter was scheduled for hearing as a contested case on April 1, 2010, at which time both the complainant and the respondents appeared and presented testimony and exhibits on the complaint. The respondents testified concerning their search for the requested records and offered to send the complainant copies of the photographs which had been located in the search. By letter dated June 21, 2010, the respondents forwarded copies of the relevant photographs to the complainant.

 

By motion to the Commission dated June 24, 2010, the complainant stated that the “case has been settled” and that he wished to withdraw his complaint in the above captioned matter.

 

The Commission takes administrative notice of the complainant’s withdrawal and recommends the following orders on the basis of the record:

 

1.      Based on the withdrawal of the complaint, the case is hereby dismissed.

 

2.  The Commission warmly commends the parties on having reached a settlement in this matter without full adjudication.
