On May 26, 2010, the Commission remanded the above captioned matter to the hearing officer at the request of the complainant. The matter was heard as a contested case on August 13, 2010, at which time both the complainant and the respondents appeared and presented testimony, exhibits and argument on the complaint.

 

At the hearing, the complainant and the respondents discussed and agreed to resolve the above-captioned matter based upon the following stipulations:

 

1.      The respondents agreed that they will file minutes as required by §1-225(a), G.S.;

2.      The respondents agreed that they would consider live broadcasting of  the respondent Committee’s meetings from Milford City Hall; and

3.      Based upon the stipulations at paragraphs 1 and 2, above, the complainant agreed to withdraw his complaint in the above captioned matter.

 

The Commission takes administrative notice of the complainant’s withdrawal and recommends the following order on the basis of the record:

 

1.      Based on the withdrawal of the complaint, the case is hereby dismissed.
