Economic Development Commission, Town of Thomaston; and Town of Thomaston,
		Respondents	June 9, 2010

                                              

The above-captioned matter was consolidated for hearing with Docket # FIC 2009-682, also captioned Paul Yoos v. Economic Development Commission, Town of Thomaston; and Town of Thomaston. Both cases were heard as contested cases on April 23, 2010, at which time both the complainant and the respondents appeared and presented testimony, exhibits and argument on the complaints.

 

Following the hearing, the complainant and the respondents discussed and agreed to resolve the above-captioned matter based upon the following stipulations:

 

1)      Henceforth, the respondent Commission agrees that it will be scrupulously careful not to conduct any deliberations at an unnoticed meeting that immediately follows the adjournment of a scheduled meeting; and

 

2)      Based upon the stipulation at paragraph 1, above, the complainant agrees to withdraw his complaint in the above captioned matter.

 

The Commission takes administrative notice of the complainant’s withdrawal and recommends the following order on the basis of the record:

 

1.      Based on the withdrawal of the complaint, the case is hereby dismissed.
