The above-captioned matter was scheduled to be heard as a contested case on December 17, 2009, at which time the complainant appeared but the respondent failed to appear due to a grave family emergency.  The hearing was rescheduled for March 9, 2010, however, by letter dated March 4, 2010, the complainant indicated that he wished “to close the case” in this matter.

 

The parties are commended for reaching an amicable settlement of the matters in this case.

 

The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

 

1.      The complaint is hereby dismissed.
