The above-captioned matter was scheduled for hearing as a contested case on March 11, 2010, at 2:00 pm, at which time the respondent appeared, but the complainant failed to appear to prosecute the complaint.

 

The Commission takes administrative notice of its recent decision in Docket #FIC 2009-145; Thomas Germain v. Town Clerk, Town of Manchester; and Town of Manchester.

 

            The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

 

            1.  The complaint is hereby dismissed for failure to prosecute.
