The above-captioned matter was heard as a contested case on September 15, 2009, at which time both the complainant and the respondents appeared and presented testimony and argument on the complaint. The matter was scheduled for a continued hearing on October 26, 2009. On October 22, 2009, the complainant informed the Commission that he wished to withdraw his complaint. The Commission takes administrative notice of such withdrawal.

 

            The following orders by the Commission are hereby recommended on the basis of the record concerning the above-captioned complaint:

 

1.      Based on the withdrawal of the complaint, the case is hereby dismissed.

 

2.  The Commission warmly commends the parties on having reached a settlement, without full adjudication, of this matter involving complex computer database issues.
