The above-captioned matter was scheduled for hearing as a contested case on April 16, 2009, at which time the respondents appeared, but the complainant failed to appear. The matter was then heard as a contested case on June 22, 2009, at which time the complainant and the respondents appeared, stipulated to certain facts and presented testimony, exhibits and argument on the complaint.

 

The undersigned hearing officer issued a report dated November 5, 2009. After the issuance of the report, the commission received a withdrawal from the complainant.

 

The Commission takes administrative notice of the complainant’s withdrawal and recommends the following order on the basis of the record:

 

1.      Based on the withdrawal of the complaint, the case is hereby dismissed.
