FREEDOM OF INFORMATION COMMISSION

The above-captioned matter was scheduled for hearing as a contested case on October 8, 2009, at which time both the complainant and the respondents appeared. Following a preliminary review of the case on the record, the parties agreed with each other to hold an off the record settlement conference without the presence of the hearing officer.

 

After the settlement conference, the parties presented the hearing officer with a proposed settlement, which included the following terms:

 

1)  Henceforth, the respondents will charge fifty cents for each disc with a sleeve, when they are requested to provide a copy of any meeting which they videotape. In the alternative, if a person making a request provides a disc or discs of appropriate quality, the respondents will provide a copy of any meeting which they videotape without charge.   

 

2)  Based upon these representations, the complainant informed the Commission that he wished to withdraw his complaint.

 

The Commission takes administrative notice of the complainant’s withdrawal and recommends the following orders on the basis of the record:

 

1.      Based on the withdrawal of the complaint, the case is hereby dismissed.

 

2.  The Commission warmly commends the parties on having reached a settlement in this matter without full adjudication.
