The above-captioned matter was heard as a contested case on September 29, 2009, at which time the complainant and the respondent appeared, stipulated to certain facts and presented testimony, exhibits and argument on the complaint.  Following a recess of the September 29, 2009 hearing, the parties indicated that they had reached a settlement of the complaint and the complainant informed the Commission that he wished to withdraw his complaint.

 

The Commission commends the parties for exercising the good judgment that was necessary to bring about a non-litigated settlement of this matter. 

 

The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

 

1.      The complaint is hereby dismissed.
