The above-captioned matter was heard as a contested case on June 4, 2009, and August 28, 2009, at which time the complainant and the respondents appeared, stipulated to certain facts and presented testimony, exhibits and argument on the complaint. Following the hearing on August 28, 2009, the respondents provided to the complainant copies of all the records that the respondents had withheld from disclosure.

Based on the respondents’ representation that all records originally withheld from the complainant were now disclosed, the complainant agreed to withdraw its complaint in this matter.

The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

1. Based on the withdrawal of the complaint, the complaint is dismissed.
