FREEDOM OF INFORMATION COMMISSION

The above-captioned matter was heard as a contested case on August 3, 2009, at which time both the complainant and the respondents appeared and presented testimony and argument on the complaint.

 

Following this process, the complainant informed the Commission that he wished to withdraw his complaint in the above captioned matter.

 

The Commission takes administrative notice of the complainant’s withdrawal and recommends the following orders on the basis of the record:

 

1.      Based on the withdrawal of the complaint, the case is hereby dismissed.

 

2.  The hearing served a valid purpose, allowing the complainant: a) to determine that certain requested records did not exist; and b) to receive a commitment that disclosure would be completed concerning two similar computer records, where the printed copies initially provided did not contain all the information entered in one given field. The Commission warmly commends the parties on having reached a settlement in this matter without full adjudication.
