The above-captioned matter was heard as a contested case on January 8, 2009, at which time the respondents appeared and presented testimony, exhibits and argument on the complaint.  The complainant failed to appear.

 

            After consideration of the entire record, the following facts are found and conclusions of law are reached:

 

            1.  The respondents are public agencies within the meaning of §1-200(1), G.S.

 

2.  By letter of complaint filed August 28, 2008, the complainant appealed to the Commission, alleging that the respondents violated the Freedom of Information (“FOI”) Act by not responding adequately to his August 20, 2008 letter.

 

3.  It is found that the complainant’s August 20, 2008 letter primarily asks questions to which the complainant demands a written response.  The complainant wanted to know why he was denied credit, what it meant when the respondents indicated that they had denied him credit because he wouldn’t be able to reinstate his current mortgage, why he couldn’t question the underwriters who had reviewed his application, and what had happened to the equity in his house.  The complainant also requested statistics regarding applications.

 

4.  It is found that the respondents attempted to answer the complainant’s questions, and additionally provided him records responsive to his request for statistics.

 

5.  It is concluded that the respondents did not violate the FOI Act as alleged.

 

 

The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

 

            1.  The complaint is dismissed with prejudice.
