The above-captioned matter was scheduled for hearing as a contested case on June 19, 2009, at which time the respondent appeared, but the complainant failed to appear. Prior to the hearing, the complainant submitted a letter making certain representations and including certain attachments. However, the letter was not in the form of an affidavit and was not subject to cross-examination at hearing.

 

            The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

 

            1.  The complaint is hereby dismissed for failure to prosecute.
