The above-captioned matter was heard as a contested case on December 29, 2008 and February 5, 2009, at which times the complainant and the respondents appeared, stipulated to certain facts and presented testimony, exhibits and argument on the complaint.  For purposes of hearing, this matter was consolidated with Docket #FIC 2008-633; David C. Villa v. Mark Douglass, Director of Purchasing and Data Processing, Town of Winchester; Keith Robbins, Town Manager, Town of Winchester; and Town of Winchester; Docket #FIC 2008-634; David C. By letter dated April 1, 2009, the complainant informed the Commission that the parties had reached an agreement in settlement of the complaint, and requested that the complaint be withdrawn.  The Commission takes administrative notice of such letter.

 

            The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

 

1.  Based on the withdrawal of the complaint, the case is hereby dismissed.
