The above-captioned matter was heard as a contested case on February 5, 2009, at which time the complainant and the respondents appeared, stipulated to certain facts and presented testimony, exhibits and argument on the complaint.  For purposes of hearing, this matter was consolidated with Docket #FIC 2008-633; David C. Villa v. Mark Douglass, Director of Purchasing and Data Processing, Town of Winchester; Keith Robbins, Town Manager, Town of Winchester; and Town of Winchester; Docket #FIC 2008-635; David C. Kenneth Fracasso, Mayor, Town of Winchester; and Town of Winchester; Docket #FIC 2008-637; David C. Villa v. Eugene Berlinski, Selectman, Town of Winchester; and Town of Winchester; Docket #FIC 2008-638; David C. Villa v. David Cappabianca, Selectman, Town of Winchester; and Town of Winchester; Docket #FIC 2008-639; David C. Villa v. At the hearing, the complainant withdrew his complaint in Docket #FIC 2008-634; David C. Villa v. Keith Robbins, Town Manager, Town of Winchester; Mark Douglass, Director of Purchasing and Data Processing, Town of Winchester; and Town of Winchester.

 

The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

 

1.      Based on the withdrawal of the complaint, the complaint is dismissed.
