The above-captioned matter was scheduled to be heard as a contested case on March 17, 2009, at which time the complainants and the respondents appeared.  For purposes of hearing, the above-captioned matter was consolidated with Docket #FIC 2008-525, David Glidden and the Connecticut State Employees Association v. Commissioner, State of Connecticut, Department of Environmental Protection, Human Resources Division; and State of Connecticut, Department of Environmental Protection, Human Resources Division.  At such time, the complainants agreed to withdraw their complaint in this matter.

The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

1.  The case is hereby dismissed.
