The above-captioned matter was scheduled for hearing as a contested case on August 4, 2008, at which time both the complainant and the respondents appeared and presented testimony and argument on the complaint. On September 4, 2008, the respondent Committee hosted a Freedom of Information workshop conducted by a member of the Commission staff. As a result, on September 5, 2008, the complainant informed the Commission that he wished to withdraw his complaint. The Commission takes administrative notice of such withdrawal.
The following orders by the Commission are hereby recommended on the basis of the record concerning the above-captioned complaint:
1. Based on the withdrawal of the complaint, the case is hereby dismissed.
2. The Commission warmly commends the parties on having reached a settlement of this matter without full adjudication.
