The above-captioned matter was heard as a contested case on June 30, 2008, at which time the complainant and the respondents appeared, stipulated to certain facts and presented testimony, exhibits and argument on the complaint. The complainant, who is incarcerated, appeared via teleconference, pursuant to the January 2004 memorandum of understanding between the Commission and the Department of Correction. See Docket No. CV 03-0826293, Anthony Sinchak v. FOIC et al, Superior Court, J.D. of Hartford at Hartford, Corrected Order dated January 27, 2004 (Sheldon, J.).
At the conclusion of the hearing, the parties reached a stipulated agreement in settlement of the complaint. The parties agreed that:
1. The respondents will provide the complainant with the cost of his incarceration and how the Department of Correction generally calculates that cost.
2. The respondents will provide to the complainant the cost to clothe an inmate pursuant to the Department’s Administrative Directives.
3. The respondents will provide the complainant with a letter stating that he is not paying twice for copies of records, and that the State is being reimbursed for non-State expenses, such as the cost of such copies.
4. The complainant will withdraw his complaint.
The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:
1. The Commission commends both parties for reaching a negotiated resolution of this complaint.
2. The complaint is dismissed.
