		Respondents	July 23, 2008

The above-captioned matter was heard as a contested case on January 25, 2008, at which time the complainant and the respondents appeared, stipulated to certain facts, and presented testimony, exhibits and argument on the complaint. At the conclusion of the hearing, the parties reached an agreement to settle the complaint as follows:

1. The respondents have, on the morning of the hearing, provided records responsive to the complainant’s request, and will provide any additional records they can find if the complainant asserts that records are missing.

2. The respondents will not charge the complainant for copies provided to him in response to the request that is the subject of this complaint.

3. The complainant withdraws his complaint.

The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

1. The complaint is dismissed.
