The above-captioned matter was scheduled for hearing as a contested case on June 20, 2008, at which time both the complainant and the respondents appeared and presented testimony, exhibits and argument on the complaint. Following this process, the parties agreed with each other to hold an off the record settlement conference without the presence of the hearing officer.

 

After the settlement conference, the parties stated on the record their agreement that:

 

a) The Freedom of Information Commission (the “Commission”) would conduct a Freedom of Information Act (“FOIA”) workshop for the members and staff of the respondent Zoning Commission and other Town of Ledyard officials who would like to attend;

 

b) Counsel for the respondents will transmit a letter to the complainant stating that: 1) the respondents could have been more prompt in providing the requested record and that the respondents will endeavor to be more prompt in the future; 2) if exemptions from the FOIA are to be invoked, the respondents will endeavor to invoke them more promptly and specifically; and 3) copies of such letter will be distributed to all land use officials in the Town of Ledyard; and 

 

c) Based upon the representations of the respondents set forth in subparagraphs a) and b) above, the complainant informed the Commission that he wished to withdraw his complaint.

 

The Commission takes administrative notice of the complainant’s withdrawal and recommends the following orders on the basis of the record:

 

 

 

1.      Based on the withdrawal of the complaint, the case is hereby dismissed.

 

2.  The Commission warmly commends the parties on having reached a settlement in this matter without full adjudication, which would have required an additional hearing and detailed inquiry concerning a question of waiver of attorney-client privilege.
