The above-captioned matter was heard as a contested case on April 28, 2008, at which time the complainant and the respondent appeared, stipulated to certain facts and presented testimony, exhibits and argument on the complaint. For purposes of hearing, the above-captioned matter was consolidated with Docket #FIC 2007-114; Tim Attolino v. Richard Austin, Warden, Borough of Woodmont; and Borough of Woodmont, however, that complaint was withdrawn prior to the hearing in this matter.
At the hearing on this matter, the respondent agreed to post, on the doors of the Borough Hall, a copy of a calendar that specifies the dates and times during which the Borough of Woodmont is open for business at which time the complainant indicated that if the respondent posted such a calendar, his disputes in this matter would be settled.
The commission commends both parties for their cooperation, which brought about the settlement of this matter.
On the basis of the record concerning the above-captioned complaint, no order is recommended by the Commission.
