The above-captioned matter was scheduled to be heard as a contested case on January 8, 2008, at which time the complainant and the respondent appeared.  At such time, the complainant and the respondent informed the Commission that they had reached an agreement settling the complaint.  Specifically, the parties agreed on the record as follows:  the respondent agreed that he would produce certified copies of the records that the plaintiff was seeking, free of charge, and, in return, the plaintiff agreed that she would withdraw her complaint. 

The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

1.      Based on the parties’ agreement, the case is hereby dismissed.

2.  The Commission commends the parties on having reached a non-litigated settlement in this matter.
