The above-captioned matter was heard as a contested case on August 1, 2007, at which time the complainant and the respondent appeared, stipulated to certain facts and presented testimony, exhibits and argument on the complaint.

After consideration of the entire record, the following facts are found and conclusions of law are reached:

1.  The respondent is a public agency within the meaning of §1-200(1), G.S.

 

2.      It is found that by e-mail dated March 23, 2007, the complainant, through his union steward, made a request to the respondent for a copy of the following records:

 

a.       “Report of Felice Orlando’s complaint of retaliation completed on or about January 2007 by Rene LeBarge,”

b.      “Report of Christine Aubry’s CHRO complaint/appeal completed on or about February 2007.  This report would include witness statements from 3 P-4 members  . . . who were interviewed by Rene LeBarge,”

c.       “All correspondence regarding Christine Aubry’s complaint of not being allowed to perform the 2006 Service Rating evaluation of District 2 survey members,” and

d.      “Documents pertaining to the withdrawal of Christine Aubrey’s CHRO complaint on or about 2001.  This would include justification documents and/or stipulation agreements.” 

 

3.      It is found that, by e-mail dated March 26, 2007, the respondent’s affirmative action (“AA”) administrator acknowledged the complainant’s request for records, indicating that she was in the process of obtaining the records. 

4.      It is found that, by e-mail dated April 11, 2007, the complainant renewed his request for a copy of the records referenced in paragraph 2, above.

5.      It is found that, by e-mail dated April 11, 2007, the respondent’s AA administrator acknowledged the complainant’s April 11, 2007 request for records, indicating that as soon as she obtained the materials, she would forward the same to the complainant.

6.      By letter dated May 7, 2007 and filed May 8, 2007, the complainant appealed to this Commission, alleging that the respondent violated the Freedom of Information (‘FOI”) Act by denying his request for records.

 

7.      Section 1-200(5), G.S., provides:

 

“Public records or files” means any recorded data or information relating to the conduct of the public’s business prepared, owned, used, received or retained by a public agency, or to which a public agency is entitled to receive a copy by law or contract under 1-218, whether such data or information be handwritten, typed, tape-recorded, printed, photostated, photographed or recorded by any other method.

 

8.      Section 1-210(a), G.S., provides in relevant part that:

 

Except as otherwise provided by any federal law or state statute, all records maintained or kept on file by any public agency, whether or not such records are required by any law or by any rule or regulation, shall be public records and every person shall have the right to . . . (3) receive a copy of such records in accordance with 1-212.

 

9.      Section 1-212(a)(1), G.S., provides in relevant part that “[a]ny person applying in writing shall receive, promptly upon request, a plain or certified copy of any public record.”

 

10.  It is found that the respondent maintains the records described in paragraph 2, above, and it is therefore concluded that such records are “public records” and must be disclosed in accordance with §§1-210(a) and 1-212(a), G.S., unless they are exempt from disclosure. 

 

11.  It is found that, on May 23, 2007, the respondent informed the complainant that 83 pages of records responsive to his requests were available.  It is further found that, on May 24, 2007, the respondent informed the complainant that he was supplementing the response with an additional 12 pages of records.

 

12.  It is found that, after a review of the outstanding records responsive to the complainant’s FOI requests, in consultation with counsel, the respondent determined that the records were exempt from disclosure pursuant to § 46a-83(G), G.S., or, in the alternative, the release of some of the records would constitute an invasion of certain employees’ personal privacy. The respondent therefore declined to disclose any additional records to the complainant.

 

13.  At the close of the hearing on this matter, the respondent submitted the outstanding records described in paragraph 2, above, to the Commission for an in camera inspection (hereinafter the “in camera records”).  The in camera records shall be identified as IC-2007-273-1 through IC-2007-273-100. 

 

14.  The following facts are helpful in understanding the complainant’s FOI request.  It is found that, on or about February 28, 2006, the complainant filed a sexual harassment complaint with the respondent’s AA division, alleging that his supervisor, Transportation Engineer Christine Aubrey, had sexually harassed him. 

 

15.  It is found that, on or about June 20, 2006, Ms. Aubrey filed a complaint with the Commission on Human Rights and Opportunities (“CHRO”) against the Department of Transportation (“DOT”), alleging, inter alia, that she was retaliated against for opposing a discriminatory practice.

 

16.  It is found that the DOT filed an affidavit in response to Ms. Aubrey’s CHRO complaint, referenced in paragraph 15, above, and that Ms. Aubrey filed a rebuttal document and several exhibits with the CHRO in response to the DOT’s affidavit. 

17.  It is found that the in camera records referenced in paragraph 13, above, consist of the exhibits that were attached to Ms. Aubrey’s rebuttal filed with the CHRO, referenced in paragraph 16, above.

18.  It is further found that, upon being served with Ms. Aubrey’s rebuttal in the CHRO matter, the respondent provided the rebuttal and exhibits thereto to its own AA division.  It is further found that upon receiving Ms. Aubrey’s rebuttal and exhibits thereto, the respondent’s AA division conducted an investigation to determine, in part, whether the allegations contained in said rebuttal had any impact on the findings concerning the complainant’s February 2006 sexual harassment complaint, referenced in paragraph 14, above. 

 

19.  It is found that the in camera records consist of the following: 1) Ms. Aubrey’s responses to witness statements taken by the respondent’s AA administrator during the respondent’s investigation into the complainant’s February 2006 sexual harassment complaint; 2) Ms. Aubrey’s notes regarding events that allegedly occurred at the DOT; 3) Ms. Aubrey’s proposed witness list for the CHRO proceeding; 4) a statement of events by another DOT employee; and 5) an e-mail from a union representative to the respondent’s AA administrator. 

 

20.  The respondent maintains that the in camera records are exempt from disclosure pursuant to §§46a-83(g), 1-210(b)(4), and 1-210(b)(2) G.S.

 

21.  With respect to the respondent’s first claim that the in camera records are exempt from disclosure pursuant to §46a-83(g), G.S., such section provides in relevant part that:

No [CHRO] commissioner or employee of the commission may disclose, except to the parties or their representatives, what has occurred in the course of [CHRO investigations or proceedings] provided the commission may publish the facts in the case and any complaint which has been dismissed and the terms of the conciliation when a complaint has been adjusted.  Each party and his representative shall have the right to inspect and copy documents, statements of witnesses and other evidence pertaining to his complaint. . . . (emphasis supplied).

 

22.  The respondent argues that §46a-83(g), G.S., should be interpreted to mean that only the parties involved in a CHRO proceeding should be permitted to inspect or copy documents filed by parties involved in a CHRO matter, regardless of whether such documents are in the possession of, and requested from, agencies other than the CHRO.  The respondent bases its argument on Personnel Director, Department of Income Maintenance v. Freedom of Information Commission, 214 Conn. 312 (1990).  The Personnel Director Court held that the statutory language of §§5-225 and 5-237, G.S., made clear that only a classified service employee could have access to his or her service rating. 

 

23.  It is found that the respondent’s AA investigation concerning the complainant’s February 2006 complaint, described in paragraphs 14 and 18, above, was not a CHRO investigation or other proceeding. 

 

24.  It is further found that the respondent’s reliance on Personnel Director is misplaced.  Such decision pertained to an entirely different statutory scheme, the logic of which cannot properly be applied, by analogy, to this case.  The statute claimed by the respondent here, §46a-83(g), G.S., explicitly prohibits only CHRO Commissioners or CHRO employees from disclosing information concerning CHRO investigations or proceedings.  Section 46a-83(g), G.S., then provides for access to evidence maintained by CHRO in connection with complaints filed with the CHRO, to the parties to the investigation or proceedings.  The statute does not contain any language prohibiting disclosure by any other individuals of records concerning CHRO investigations or proceedings, when such records are maintained by other agencies, such as the respondent, and used in a separate and independent investigation of a different complaint. 

 

25.  It is concluded that the provisions of §46a-83(g), G.S., do not apply to the disclosure of records maintained by the respondent and used by the respondent to conduct its own separate investigation of a different matter and, therefore, the records are not exempt from disclosure pursuant to §46a-83(g), G.S.

26.  With respect to the respondent’s second claim, §1-210(b)(4), G.S., provides that nothing in the FOI Act shall require the disclosure of:

 
Records pertaining to strategy and negotiations with respect to pending claims or pending litigation to which the public agency is a party until such litigation or claim has been finally adjudicated or otherwise settled.

27.  It is found that Ms. Aubrey’s complaint against the DOT filed with the CHRO, as referenced in paragraph 15, above, was pending as of the date of the hearing on this matter.  It is, therefore, found that such complaint constitutes “pending litigation” within the meaning of §1-210(b)(4), G.S.

28.  It is found, however, after a careful review of the in camera records, that such records do not constitute records of “strategy or negotiations” pertaining to the pending litigation within the meaning of §1-210(b)(4), G.S.

29.  It is therefore concluded that the in camera records are not exempt from disclosure pursuant to §1-210(b)(4), G.S.

30.  The respondent next contends that the following in camera records contain medical or sexually explicit information, or identify a sexual harassment complainant, and that such information is exempt from disclosure pursuant to §1-210(b)(2), G.S.: IC-2007-273-3; IC-2007-273-6; IC-2007-273-17; IC-2007-273-45; IC-2007-273-50; IC-2007-273-52; IC-2007-273-56; IC-2007-273-62; IC-2007-273-68; IC-2007-273-69; IC-2007-273-81; IC-2007-273-83; IC-2007-273-84; and IC-2007-273-96. 

31.  Section 1-210(b)(2), G.S., provides in relevant part that nothing in the FOI Act shall require the disclosure of  “. . . personnel or medical files and similar files the disclosure of which would constitute an invasion of personal privacy . . . .”

 

32.  In Perkins v. Freedom of Information Commission, 228 Conn. 158, 175 (1993), the Supreme Court set forth the test for the exemption contained in §1-210(b)(2), G.S.  The claimant must first establish that the records in question are personnel, medical or similar files.  Second, the claimant must show that disclosure of the records would constitute an invasion of personal privacy.  In determining whether disclosure would constitute an invasion of personal privacy, the claimant must establish both of two elements: first, that the information sought does not pertain to legitimate matters of public concern, and second, that such information is highly offensive to a reasonable person.   The Commission takes administrative notice of the multitude of court rulings, Commission final decisions1, and instances of advice given by the Commission and staff members2, which have relied upon the Perkins test, since its release in 1993.

 

33.  It is found that the respondent provided the following individuals, on the dates indicated below, with written notice of the FOI request, and informed them of their right to object to the disclosure of the records: Ms. Aubrey, July 25, 2007;  James Mullen, July 26, 2007; Richard Henn, July 26, 2007; Robin Thompson Holowaty, July 26, 2007; Charles LaChance, July 26, 2007; Arthur Von Plachecki, July 26, 2007; and Myron Cohen, July 31, 2007.

 

34.  It is found that the following individuals, on the dates indicated below, objected to the release of the records: Ms. Aubrey, July 27, 2007; Richard Henn, July 30, 2007; Robin Thompson Holowaty, July 30, 2007. 

 

35.  It is found that the following individuals, on the dates indicated below, did not object to the release of the records:  Arthur Von Plachecki, July 27, 2007 and Charles LaChance, July 27, 2007. 

 

36.  It is further found that at the time of the hearing in this case, James Mullen had objected orally to the release of the records, and Myron Cohen had not responded in any form to the respondent’s written notice of the FOI requests.

 

37.  Section 1-214, G.S., provides in relevant part that:

 

(b) Whenever a public agency receives a request to inspect or copy records contained in any of its employees’ personnel or medical files and similar files an the agency reasonably believes that the disclosure of such records would legally constitute an invasion of privacy, the agency shall immediately notify in writing (1) each employee concerned, provided such notice shall not be required to be in writing where impractical due to the large number of employees concerned and (2) the collective bargaining representative, if any, of each employee concerned.  Nothing herein shall require an agency to withhold from disclosure the contents of personnel or medical files and similar files when it does not reasonably believe that such disclosure would legally constitute an invasion of personal privacy. (Emphasis supplied).

 

(c) A public agency which has provided notice under subsection (b) of this section shall disclose the records requested unless it receives a written objection from the employee concerned or the employee’s collective bargaining representative, if any, within seven business days from the receipt by the employee or such collective bargaining representative of the notice or, if there is no evidence of receipt of written notice, not later than nine business days from the date the notice is actually mailed, sent, posted or otherwise given.  Each objection filed under this subsection shall be on a form prescribed by the public agency, which shall consist of a statement to be signed by the employee or the employee’s collective bargaining representative, under the penalties of false statement, that to the best of his knowledge, information and belief there is good ground to support it and that the object is not interposed for delay.  Upon the filing of an objection as provided in this subsection, the agency shall not disclose the requested records unless ordered to do so by the Freedom of Information Commission pursuant to section 1-206.

 

38.  Because more than four months elapsed between the complainant’s initial FOI request, and the respondent’s notification to the individuals referenced in paragraph 33, above, it is concluded that the respondent violated §1-214(b), by failing to “immediately” notify in writing each employee concerned. 

 

39.  The Commission notes that although some of the notified employees objected to the disclosure of the subject records, and that such employees were aware of the proceedings in this matter, no one appeared to intervene or testify at the August 1, 2007 hearing.

 

40.  It is found that the in camera records listed in paragraph 30, above, constitute “similar” files within the meaning of §1-210(b)(2), G.S. 

 

41.  It is also found that portions of IC-2007-273-68, IC-2007-273-69, IC-2007-273-81 and IC-2007-273-84 contain medical information.

 

42.  It is also found that IC-2007-273-56 contains the identity of another sexual harassment complainant as well as an alleged sexual harasser, both unrelated to this case.

 

43.  It is further found that the information contained in the records described in paragraphs 41 and 42, above, does not pertain to a legitimate matter of public concern and that the disclosure of such information in this case, as specifically identified in paragraphs 44 through 47, below, would be highly offensive to a reasonable person.

 

44.  It is concluded that disclosure of in camera record IC-2007-273-68, paragraph six, starting with the word following the word “is” and ending with the word preceding the word “to,” would constitute an invasion of personal privacy and is exempt from mandatory disclosure pursuant to §1-210(b)(2), G.S.

 

45.  It is further concluded that disclosure of in camera record IC-2007-273-69, paragraph 3, starting with the word following the number “2” and ending with the last word in this same sentence, would constitute an invasion of personal privacy and is exempt from mandatory disclosure pursuant to §1-210(b)(2), G.S.

 

46.  It is further concluded that the disclosure of in camera record IC-2007-273-81, paragraph 1, starting with the word following the word “surveys” and ending with the word preceding the word “he,” in the fifth line, would constitute an invasion of personal privacy and is exempt from mandatory disclosure pursuant to §1-210(b)(2), G.S.  It is further concluded that the disclosure of the first sentence in paragraph four of IC-2007-273-84 would constitute an invasion of personal privacy and is exempt from mandatory disclosure pursuant to §1-210(b)(2), G.S. 

 

47.  It is further concluded that the disclosure of the names listed in paragraph four of in camera record IC-2007-273-56 would constitute an invasion of personal privacy and are exempt from mandatory disclosure pursuant to §1-210(b)(2), G.S. 

 

48.  It is concluded that the respondent did not violate the FOI Act by failing to disclose those portions of the in camera records specifically identified in paragraphs 44 through 47, above.

 

49.  It is found that the remainder of the in camera records contains information pertaining to allegations of acts of discrimination, retaliation and other on-duty employee misconduct.  It is further found that these records detail the location and date that such events occurred, the respondent’s employees’ statements concerning such events, certain questions posed to witnesses as part of the respondent’s investigation, as well as a union representative’s request for information concerning these events.

 

50.  It is found, therefore, that the remainder of the in camera records pertains to legitimate matters of public concern. 

 

51.  It is further found that disclosure of the in camera records, with the exception of those portions specifically identified in paragraphs 44 through 47, above, would not be highly offensive to a reasonable person.

 

52.  Based on the foregoing, it is concluded that the respondent violated the disclosure provisions of §§1-210(a) and 1-212(a), G.S., by denying the complainant copies of the in camera records, excluding those portions that are exempt from disclosure as specifically identified in paragraphs 44 through 47, above. 

 

The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint.

 

1.  The respondent shall forthwith provide the complainant with a copy of the in camera records, free of charge. 

 

2.   In providing the records to the complainant, the respondent may redact from the in camera records those portions specifically identified in paragraphs 44 through 47, above. 

 

3.   Henceforth, the respondent shall strictly comply with the provision of §§1-214(b), 1-210(a) and 1-212(a), G.S.

AFFIDAVIT OF ERIC V. TURNER

 

Eric V. Turner, having been duly sworn, does hereby depose as follows:

 

1.  I am over the age of eighteen (18) years and understand the obligation of an affirmation.

 

2.  I am a member of the Connecticut Bar and am currently employed as Director of Public Education for the Connecticut Freedom of Information Commission, having first been employed by said commission in 1996.

 

3.  I am providing this affidavit in light of the Supreme Court decision in Director, Retirement & Benefits Services Division v. Freedom of Information Commission, 256 Conn. 764 (2001), in which the court apparently invites a reconsideration of Perkins v. Freedom of Information Commission, 228 Conn. 158 (1993).  See, Director, supra at 782, fn 13, 785 (Zarella, J. concurring).

 

4.  As part of my responsibilities as Director of Public Education for said commission, I have developed, organized and scheduled speaking engagements, seminars and programs explaining the duties and rights established under the Connecticut Freedom of Information Act.

 

5.  Since I assumed my current position in 1996, there have been approximately 290 such speaking engagements, seminars and programs in Connecticut and I have personally lectured in approximately 80 such speaking engagements, seminars and programs.

 

6.  As part of the presentation I have prepared for such speaking engagements, seminars and programs, the subject of the Connecticut General Statues Section 1-210(b)(2) exemption for personnel, medical and similar files the disclosure of which would constitute an invasion of personal privacy is stressed because of the great interest in that exemption and the confusion generated by a series of inconsistent and contradictory court decisions prior to Perkins, supra.  See, e.g., Chairman v. Freedom of Information Commission, 217 Conn. 193 (1991) (establishing “reasonable expectation of privacy” test; query whether subjectively or objectively applied) and Board of Education v. Freedom of Information Commission, 210 Conn. 590 (1989) (confirming a “balancing” test), which was overruled by the Chairman case.

 

7.  Since the Supreme Court ruling in Perkins, supra, all Freedom of Information Commission staff members who conduct such speaking engagements, seminars and programs discuss in detail the rulings in that case and its progeny.

 

8.  As part of my responsibilities as Director of Public Education, I also answer telephone and other inquiries from public officials and the public.  Since my employment with said commission, I have answered thousands of such inquiries, including hundreds of inquiries concerning the Connecticut General Statutes Section 1-210(b)(2) exemption.  In responding to such inquiries I discuss in detail the Perkins case and its progeny.

 

9.  Based on the foregoing experiences, it is my opinion that the Perkins decision, and its progeny, have had a beneficial effect on public officials and the public itself because they can rely on a now long-standing and clear test with respect to the Connecticut General Statutes Section 1-210(b)(2) exemption, which helps them determine whether that exemption is applicable to the practical problems they encounter with respect to personnel, medical and similar information.  Indeed, the many court and Freedom of Information Commission decisions applying the Perkins test have given public officials and the public a now consistent body of law concerning that statutory exemption.
