FREEDOM OF INFORMATION COMMISSION

            The above-captioned matter was heard as a contested case on August 9, 2007, at which time the complainant and the respondent appeared and presented testimony, exhibits and argument on the complaint.

 

            On October 12, 2007, the hearing officer reaffirmed in writing an order for records to be submitted for in camera  inspection.  On October 25, 2007, the respondent filed a comprehensive set of the requested records, together with a detailed index.  A continued hearing was scheduled for November 30, 2007.

 

            By email dated November 26, 2007, the complainant requested that the complaint in this matter be withdrawn.  The Commission takes administrative notice of such email.

 

            The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

 

1.      Based on the withdrawal of the complaint, the case is hereby dismissed.
